On 11 December 2013 Tomás Ojea Quintana, the Special Rapporteur on the human rights situation in Myanmar, welcomed the release of 44 prisoners of conscience in Myanmar, hailing it as an important step towards fulfilling President Thein Sein’s pledge of freedom for all political prisoners by the end of this year. “When I look back to the start of my mandate in 2008, I was referring to figures of over 1,900 persons detained on political grounds. It is important to acknowledge the significance of the progress that has been made: today we are referring to figures of less than 50”. The expert said the practice of arresting those who express views that are different to those of the Government became embedded during 50 years of military rule. “Moving to a culture of democracy, where people are free to express their views, will take time,” he stated. “The releases today are a step towards this, but need to be accompanied by legislative reforms.” However on 17 December the Observatory for the Protection of Human Rights Defenders, a joint programme of FIDH and OMCT, welcoming the latest release of prisoners of opinion in Burma/Myanmar, deplored the re-arrests of human rights defenders Ko Htin Kyaw and Aye Thein within hours of their “release”. Front Line reported that on 3 December 2013, Tin Htut Pai was arrested for his involvement in commemorating the one-year anniversary of the protests against the Letpadaung mining project. Tin Htut Pai is currently detained but has not been permitted to see his lawyer. Tin Htut Pai is the founder of Generation Youth, an organisation that advocates for youth empowerment and campaigns against land confiscation.
On 10 January 2014 this was followed by praise from the spokesperson for the UN High Commissioner for Human Rights, Rupert Colville, for President Thein Sein’s announcement on 2 January that he would commute death sentences to life imprisonment and reduce some sentences on humanitarian grounds and to mark the 66th anniversary of independence of the country. The move is “very significant” for Myanmar, which has not carried out the death penalty since 1989, the spokesperson noted, as the country assumed the chair of the Association of Southeast Asian Nations (ASEAN).

The mission to Honduras was made up of Baltasar Garzón, a Spanish jurist and human rights defender; Luis Guillermo Pérez Casas, attorney and head of the FIDH mission; Lisa Haugaard of the Latin America Working Group; Annie Bird of Rights Action; Mirna Perla, former magistrate of the Supreme Court of Justice of El Salvador; Julieta González from APRODEV-Advocacy Program for Central America in Brussels; Susanna Daag from the Copenhagen Initiative for Central America (CIFCA) in Brussels; Hollman Morris, Colombian journalist and human rights defender; Enrique Santiago of the Foro de Abogados of Spain; Beatriz Gil from the Institute for Political Studies on Latin America and Africa (IEPALA) in Spain; and Pascal Paradis from Lawyers without Borders, Canada. The mission was carried out with the support of CIPRODEH.
The report of 20 December 2013 highlights the following:
- deep concern over the attacks and threats made against the human rights defenders mentioned in its November 23, 2013 press release, including journalists and those who work to defend women, indigenous and Garifuna territories, natural resources, and the lesbian, gay, transsexual, bisexual, and intersexual community. The mission had access to two blacklists targeting leaders of social and labor organizations, human rights defenders, journalists, and members of the Libertad y Refundación political party and indicating they would be murdered.
- concern over the recent and apparently arbitrary transfer of public prosecutors who had been working in the Special Human Rights and Anti-Corruption Prosecutors’ Offices and the impact of these transfers on the work necessary to overcome the high level of impunity in the country.
- number of irregularities in the election process identified through multiple reports from diverse sectors of Honduran civil society.
- a lack of transparency around the funding of political campaigns and the sources of political party funding.
- strong presence of the Armed Forces during the course of the elections.
- reports that during the course of the last few days, four people linked to the Partido Libertad y Refundación have been murdered. These numbers are over and above the 39 murders that have taken place since May of last year, mostly of members of the same party.

On December 12, 2013, the Anti-Discrimination Centre (ADC) “Memorial” was officially declared a “foreign agent” by the Leninsky District Court of St Petersburg, and was ordered to register as such with the Ministry of Justice, according to information received by the Observatory for the Protection of Human Rights Defenders. Today, the court unexpectedly established that all the activities of ADC “Memorial” fall under the definition of “performing the functions of a foreign agent”. Accordingly, for the first time, a court has directly labelled a human rights NGO a “foreign agent”, and did not just order it to register as such. This decision could pave the way to increased harassment of all human rights organisations in the Russian Federation. Read the rest of this entry »

Human rights defenders play a critical role in exposing and ensuring accountability for business-related human rights violations. Despite this, around the world, there is an increase in attacks, judicial harassment, restrictions, surveillance, intimidation and reprisals against defenders who work on land and environment issues associated with business activities. A side event on 3 December in Geneva (Palais des Nations Room XX from 13h00 to 15h00) will pay special attention to challenges engendered by the increasing criminalisation or repression of those peacefully denouncing adverse human rights impacts of corporate projects, discussing the role of both States and companies. The OMCT and the FIDH, in the framework of the Observatory for the Protection of Human Rights Defenders, made an intervention under agenda item 9: “Situation of human rights defenders” at the at the 54th session of African Commission on Human and Peoples Rights [ACHPR] on 5 November.
Human rights defenders were attacked, received threats or were slandered in the DRC, Senegal and Tunisia. In some cases they were even killed, as in the DRC and in Cameroon, in a climate of impunity. Defenders, and in particular defenders of economic, social and cultural rights, also continued to be subjected to arbitrary arrests and judicial harassment in Angola, Cameroon, the DRC, Egypt, Mauritania and Tunisia. The Office of the UN High Commissioner for Human Rights (OHCHR) should esta
blish a mission in Belarus, the delegates to the Third Belarusian Human Rights Forum, which took place in Vilnius on Saturday and Sunday, say in a statement on 27 October. The delegates also urge the Organization for Security and Cooperation in Europe (OSCE) to take measures to encourage Belarusian authorities to respect human rights. It is necessary for the OSCE Parliamentary Assembly to preserve its Ad Hoc Working Group on Belarus and for all OSCE institutions and bodies, including the Office for Democratic Institutions and Human Rights, to step up cooperation with Belarus’ civil society. The delegates condemn violations of human rights by Belarusian authorities and urge them to abide by international commitments and implement recommendations within the framework of the UN Universal Periodic Review. Authorities should invite all UN special rapporteurs to visit Belarus, above all, the UN Human Rights Council’s special rapporteur on Belarus.
At the same meeting, Ales Bialiatski‘s wife called on the West to be consistent in relation to Belarus. Natallia Pinchuk calls not to close the question of rehabilitation, not to reduce pressure on the Belarusian authorities and not to make concessions until all political prisoners are released, Radio Svaboda reports. “Some human rights defenders began to propose in their articles and speeches to lift demands for the full rehabilitation of political prisoners. They say the regime will never agree on it. But I think we must be consistent first of all. If we began to demand the rehabilitation, we must keep to this position. Secondly, people’s rights remain restricted without rehabilitation. They have only half-freedom,” she said. “We, relatives of the political prisoners, expect firmness and applying all instruments from the European Union and the US. It’s very important that the US and Europe have a concerted approach,” she said. Natallia Pinchuk is sure that her husband, who serves his term in a correctional colony shares her opinion.

Nominations for the 2014 MARTIN ENNALS AWARD FOR HUMAN RIGHTS DEFENDERS (MEA) can now be submitted electronically at http://www.martinennalsaward.org. Deadline: 9 December 2013.
The Award is granted annually to an individual, or exceptionally an organisation, in recognition of their commitment and ongoing efforts in the defence and promotion of human rights. Nominees must be currently involved in work for the promotion and protection of human rights. Special account is taken of those who are at risk and have demonstrated an active record of combating human rights violations by courageous and innovative means. The MEA aims to encourage individuals or organisations, particularly those who are working in conditions hostile to fundamental human rights and who are in need of protection.
The present value of the annual Award is 20’000 Swiss Francs, to be used for further work in the field of human rights. The following organisations participate in the Jury that selects the award: Amnesty International, Human Rights Watch, Front Line, Human Rights First, International Federation for Human Rights, the World Organisation Against Torture, International Commission of Jurists, International Service for Human Rights, Protestant Agency for Diakonia and Development (Germany) and HURIDOCS.
The Ceremony is hosted by the City of Geneva in late 2013. They provide each of the final three nominees with project funds of 11’650 CHF and a 5’000 CHF travel grant.

This blog tends to prioritize news on human rights defenders who are in trouble. This makes one overlook perhaps too often the contribution made by those who are working for the cause in other ways. To rectify I want to pay tribute to another woman who has contributed enormously to the creation and growth of the Martin Ennals Award for Human Rights Defenders: Simia Ahmadi. After 20 years she is leaving the Board of the Foundation on 7 October, just before the 20th ceremony tomorrow.
In 1992 Simia was a young, upcoming human rights worker who had just finished an internship with the UN. To her great regret she never met Martin Ennals in person. Her main motivation was that an award could be effective and volunteered to help it being set up. After successful initial fundraising she was the part-time Secretariat in the first year.

After that, she worked several years for the International Federation for Human Rights (FIDH). Thereafter she was Programme Coordinator of the Legal and Human Rights Centre in Tanzania and from 2006-2009 she served as FIDH’s Representative to the UN in Geneva. After her move to Kenya in 2010, she served as the Chief of Party of the Public International Law and Policy Group in Kenya. Now she devoting her considerable energy to Kahesa, of which she is the Director-Founder and undertakes consultancy work such as evaluations KAHESA is a social enterprise that produces decorative and environmentally-sound paper through the employment of mentally-challenged Kenyans. For being at the cradle of the MEA and making sure that the there is no grave for long time she deserve the deepest thanks from all especially Human Rights Defenders around the world.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), reports on 2 October 2013 on the ongoing judicial proceedings against the Anti-Discrimination Centre “Memorial” (ADC Memorial), which has now become the first NGO in Russia facing both administrative and civil proceedings for the same “offence” on the basis of the law on so-called “foreign agents”.
