It is not often that we can write about Trinidad and Tobago but when the Inter-American Commission on Human Rights [IACHR] calls on Trinidad and Tobago “to fully investigate and prosecute” those responsible for the murder of prominent Senior Counsel, Dana Seetahal, there is a good reason. The former state prosecutor and magistrate, was shot and killed on 4 May. This is reinforced by the legal reasoning of the IACHR which recalls “”. ….in this sense, acts of violence and other attacks perpetrated against human rights defenders not only affect the guarantees that every human being must enjoy, but also seek to undermine the fundamental role that human rights defenders play in society and leave all those for whom they fight defenseless. “The work of human rights defenders is essential to building a solid and enduring democratic society, as they play a leading role in the pursuit of the full attainment of the rule of law and the strengthening of democracy.”

reports that yesterday, 7 May 2014, human rights defender Mr Rashid Rehman was shot and killed in an attack on his office in Kutchery Square, Multan, Pakistan. Two other people were injured in the shooting, which was carried out by two unknown men. Rashid Rehman was a human rights lawyer and a coordinator of the Punjab office of the Human Rights Commission of Pakistan (HRCP) in Multan. The human rights defender advocated against the misuse of blasphemy laws in Pakistan and, since February 2014, had been working on the case of Junaid Hafeez, a lecturer at Bahauddin Zakariya University who is accused of blasphemy. It is reported that no lawyer was willing to take the case for a year because of fear of reprisals from extremist religious groups. reports that on 22 March 2014, human rights defender and director of Radio Free Iraq, Mr Mohammed Bedaiwi, was shot dead, allegedly by an officer of the Presidential Regiment, in Baghdad. Mohamed Bedaiwi was a professor at the University and, for the past two years, the director of the Baghdad office of Radio Free Iraq. The station broadcasts from Prague. Mohammed Bedaiwi was stopped at a checkpoint on his way to work. An argument began between an officer and the human rights defender, and other officers reportedly began to beat Mohammed Bedaiwi. The incident culminated in the killing of the human rights defender. Reports indicate that the officer has been arrested but his identity has not been disclosed, leading to fears that the case may end in impunity. Mohammed Bedaiwi was very well-known and local sources consider it unlikely that the officers did not recognise him. On 23 March 2014 over 40 media institutions, including newspapers, radio stations and satellite TV channels, refrained from publishing or broadcasting in protest at the killing of Mohammed Bedaiwi. There have also been vigils and marches around the Iraqi capital in honour of the human rights defender. The press syndicate has expressed its concern about the killing of a journalist by an armed officer of the Presidential Guard.

The OMCT and the FIDH, in the framework of the Observatory for the Protection of Human Rights Defenders, made an intervention under agenda item 9: “Situation of human rights defenders” at the at the 54th session of African Commission on Human and Peoples Rights [ACHPR] on 5 November.
Human rights defenders were attacked, received threats or were slandered in the DRC, Senegal and Tunisia. In some cases they were even killed, as in the DRC and in Cameroon, in a climate of impunity. Defenders, and in particular defenders of economic, social and cultural rights, also continued to be subjected to arbitrary arrests and judicial harassment in Angola, Cameroon, the DRC, Egypt, Mauritania and Tunisia. 14 September 2013 marked three years since renowned human rights defender David Ravelo Crespo, member of the director’s board of the Regional Corporation for the Defense of Human Rights (CREDHOS) based in the city of Barrancabermeja, was detained. Over NGOs reiterated on that occasion their concerns regarding a series of irregularities that were reported throughout the proceedings which resulted in his conviction and sentencing to 220 months in prison. Reiterating their respect for the independence of the judiciary in Colombia, the NGO statement lists a series of irregularities (see statement in full). The NGOs stress that David Ravelo Crespo is an internationally renowned human rights defender. He has won several awards such as the San Pedro Claver Award from the Diocese of Barrancabermeja in 2009; was one of the finalists for the 2013 Front Line Defenders Award fand has been nominated for the National Human Rights Defenders Awards in Colombia . His NGO was nominated for the 2013 Human Rights Award for the city of Weimar (Germany).
Two weeks later Front Line reports that human rights defender and campesina leader Adelinda Gómez Gaviria was killed in Almaguer, Cauca region. Adelinda Gómez Gaviria worked with the Comité de Integración del Macizo Colombiano – CIMA. She played an active role in the Mining and Environmental Forum in Almaguer, which has 1,500 indigenous and farming members. On 30 September as Adelinda Gómez Gaviria was returning home after a meeting, she and her 16 year-old son were approached and shot at by two unidentified men. Adelinda Gómez Gaviria suffered five bullet wounds and was killed, whilst her son is in a critical state in the Clínica La Estancia in Popayán city. One month prior to her killing Adelinda Gómez Gaviria had received a threatening telephone call from strangers who warned her to: “Stop messing around with this miners’ thing. It’s risky and it’ll get you killed.” The Red por la Vida y los Derechos Humanos del Cauca (Cauca Network for Life and Human Rights) has registered the murders of fourteen women human rights defenders in Cauca so far this year, primarily from rural areas of Cauca. Twelve death threats against human rights defenders have been reported, with five of those against women.

Business Week reports on 14 August that rebels in the Democratic Republic of Congo’s Katanga province murdered a human-rights investigator who criticized their movement for committing abuses against civilians. Armed men from the secessionist Kata Katanga group [whose name means “cut out Katanga” in the Swahili language] forced their way into the victim’s house on 7 August before killing him, according to Scott Campbell, the director of the UN’s joint human-rights office in Congo. The UN mission, known as Monusco, wouldn’t release the victim’s name or organization for security reasons, Campbell said. “Monusco is gravely concerned by the arbitrary execution” of the activist, it said in a separate e-mailed statement that also called on Congolese authorities to protect human-rights defenders and their families. Almost 370,000 people have been displaced in the province as of July, mainly because of the violence, according to the UN’s Office for the Coordination of Humanitarian Affairs.

The New York based Center for Constitutional Rights called on US President Barack Obama last week to break his three-year silence over Israel’s 2009 killing of 18-year-old US citizen Furkan Doğan during its siege on the Gaza-bound Mavi Marmara ship in international waters.

Karl Ombion, writing for Bulatlat.com, reports that in a court hearing on 18 April 2013 at RTC Branch 55, in Himamaylan City, Adjutant General Alexis Gopico and Lt. Col Ricardo B Bayhon positively identified the two suspects in the brutal murder of Philippine human rights defender Benjamin Bayles as military enlisted men. Edre Olalia, legal counsel of the victim’s family, and Secretary General of National Union of People’s Lawyers (NUPL), confirmed this report. Bayles was murdered 14 June 2010 by two suspects who claimed to be Roger Bajon and Ronnie Caurino when they were captured by Himamaylan police operatives hours after the incident. Olalia said “the confirmation, positive identification and specific personal pinpointing of the killers of activist Benjamen Bayles by top army officials as enlisted personnel under their command is a welcome development and a high point in making perpetrators of extra judicial killings accountable.” This is ultimately a product of public vigilance and pressure by human rights defenders aided also by conscientious legal work, Olalia stressed, but it remains to be seen if this leads to a deeper investigation, determination of other guilty parties, including possibly, superior officers. The accused who are lowly private first class personnel maybe sacrificial dispensable small fry to stop the investigation and let masterminds escape identification and prosecution.”“As in other cases, like that of Jonas Burgos, extra judicial killings and enforced disappearances and other rights violations, there is no closure until there is full justice for the victims,” Olalia concluded.

NGOs as well as the Inter-American Commission on Human Rights (IACHR) condemn the murder of Ever Cordero, chairman a participatory dialogue process for victims of displacement in the department Córdoba, Colombia.
Ever Cordero was a community leader who worked to bring about the restitution of lands for victims of the armed conflict. On April 9, 2013, Ever Cordero was traveling toward the urban area of Valencia, in Córdoba, when two individuals on a motorcycle intercepted him and shot him to death. Ever Cordero was going to Valencia to attend ceremonies and marches commemorating the National Day of Memory and Solidarity with Victims.
