Twenty years after the Beijing Platform made promising pronouncements, it is sobering to hear from women human rights defenders who are under attack for their work:

Nawaf Al Hendal: portrait of a human rights defender from Kuwait

On 30 January 2015 the ISHR Bulletin did a good write-up on Nawaf Al Hendal, a Human rights defender from Kuwait.

The Universal Periodic Review of Kuwait took place at the Human Rights Council in Geneva on 28 January 2015. Prominent human rights defender, Nawaf Al Hendal, who travelled to Geneva for the review of Kuwait’s human rights record, was advised that an arrest warrant awaits him on return to Kuwait in connection with allegations of damaging foreign relations and using Twitter to insult lateSaudi King Abdullah. Nawaf discussed the situation for human rights defenders in Kuwait and the on-going threat of reprisals with ISHR.

Nawaf Al Hendal, the founder of Kuwait Watch, has been an active human rights defender in Kuwait since 2004. Nawaf’s drive to become a human rights defender initially arose when he witnessed his colleagues being subject to unfair work standards imposed by his employer at the time. Nawaf could not allow his colleagues’ rights to be eroded without any resistance. For this reason, when his colleagues felt unable to do so, Nawaf decided to fight for the protection of their rights.

‘I love my country and its people. I believe that every person in Kuwait should have access to fundamental and equal rights.’

When Nawaf realised he was able to have an impact in the protection of his colleagues’ rights, his focus extended to the protection of people’s rights more generally in Kuwait.

Nawaf is well known for his work defending the rights of stateless persons, including the Bedouin community who are deprived of the right to employment, education and healthcare in Kuwait. Nawaf, now through Kuwait Watch, is active in engaging with the UN human rights system, including making submissions to the UPR, various treaty bodies and States active in the human rights system, as well as international NGOs. Kuwait Watch also actively engages in grass roots advocacy, including organising peaceful protests and consulting with employers and medical practitioners to gain employment and medical care for Bedouin people.

Nawaf is adamant about the importance of social media in the work of human rights defenders.

‘We use social media to demonstrate the restrictions on fundamental freedoms placed on people in Kuwait to the rest of the world. We also use social media to make it clear to the Kuwaiti authorities that we will continue to defend the rights of all people in Kuwait.’

Overall, Nawaf considers that his work thus far has not gone unnoticed by the Kuwaiti authorities. Despite the troubling implications for Nawaf as an individual, he considers that the fact that a warrant for his arrest was issued simultaneously with his travel to Geneva for the periodic review of Kuwait is indicative of the Kuwaiti Government’s concern in relation to the increasing influence of Kuwaiti human rights defenders.

Nawaf explains that his advocacy is not politically driven, it is rights driven. He emphasised that Kuwait Watch is not seeking a political transformation in government but simply the development of legal protections for people in Kuwait.

‘We [Kuwait Watch] commended the Kuwaiti Government’s decision to make primary and intermediate education free and compulsory for children and prohibit children under the age of 15 years from working.’

The prosecution of human rights defenders, opposition activists and bloggers for allegedly undermining the status of the emir of Kuwait is widespread in the country. Lese-majeste, national security and ‘national unity’ laws have recently been used to prosecute activists who are critical of the human rights records of heads of state with which Kuwait has diplomatic relations, including Saudi Arabia and Egypt. According to Nawaf, the Public Gatherings Law, the Penal Code, national security legislation, press regulations, and lese-majeste and blasphemy laws, are all used and abused to criminalise free speech in the country.

‘As a human rights defender in Kuwait you are always at risk. In an attempt to silence dissenting voices, human rights defenders are often imprisoned for unrelated, and often fabricated, offences.’

Nawaf tells the story of his arrest in 2013 on his return to Bahrain, where he had been studying at Delmon University for Science & Technology since 2008. Nawaf was advised that he could no longer enter Bahrain as the Kuwaiti authorities intended to arrest him in connection with terrorist activities.

‘Since my arrest in 2013, I have not been able to return to Bahrain and my five years of study in Bahrain have not been recognised.’

Nawaf explained that in an additional attempt to silence dissenting voices, national newspapers and television channels have been known to print articles in an attempt to invalidate the work of human rights defenders.

‘In addition to legislation restricting fundamental rights of people living in Kuwait and the independence of human rights institutions, the legislative framework limits the number of human rights organisations to one’

Given the restriction on the number of human rights organisations in Kuwait, Kuwait Watch is registered in the United Kingdom.

‘We engage with the UN human rights system in the hope that the UN will require the Kuwait Government to enact and reform legislation to protect human rights defenders as well of the rights of all people in Kuwait.’

Nawaf emphasises the importance he places on ensuring that the next generation will have the fundamental rights they are entitled to.

‘I recognise that I may never be granted these fundamental rights in my life time, but I want more for our children. We should promise them that.’

In spite of all the protests: still six month sentence for Nabeel Rajab in Bahrain

Nabeel Rajab, has been sentenced to six months in prison for posting comments online which were considered insulting to the Ministries of Interior and Defence.

Further to my post of this morning [https://thoolen.wordpress.com/2015/01/20/video-statement-of-troublemaker-nabeel-rajab-who-is-on-trial-today/], Nabeel Rajab was  unjustly punished and got – simply for posting tweets deemed insulting to the authorities – six months prison. “His conviction is a blow to freedom of expression – it must be quashed. He should be released immediately and unconditionally” said Boumedouha, Deputy Director of Amnesty International’s Middle East and North Africa Programme.

Video statement of ‘troublemaker’ Nabeel Rajab who is on trial today

Today, 20 January, a verdict is expected in the trial of Nabeel Rajab, an internationally recognized human rights defender in Bahrain. President of the Bahrain Center for Human Rights (BCHR), Deputy Secretary General of the International Federation for Human Rights (FIDH), and a member of Human Rights Watch’s Advisory Board, Rajab is charged with insulting public institutions via Twitter. A huge number of NGOs (see below) strongly condemn the politically motivated prosecution of Nabeel Rajab and call on the Government of Bahrain to drop all charges against the peaceful human rights defender. On 1 October 2014, Rajab was arrested after hours of interrogation regarding one of his tweets. Rajab had just returned to Bahrain from a months-long advocacy tour, which included appearances at the 27th Session of the UN Human Rights Council in Geneva and the European Parliament in Brussels, as well as meetings with foreign ministries throughout Europe. Charged with insulting public institutions under article 216 of Bahrain’s penal code, Rajab was granted bail on 2 November 2014, but was banned from leaving the country.

[Rajab is one of many Bahrainis who have been victimized by the government’s intensified campaign to silence dissent: On 28 December, Sheikh Ali Salman, General-Secretary of Bahrain’s largest opposition party Al-Wefaq, was arrested for his political and human rights activism. Civil society calls on EU to intensify support for human rights defenders in the new EU Action Plan

Seven major NGOs (Amnesty International, Frontline Defenders, International Federation for Human Rights, Human Rights Watch, PBI, Protection International and the World Organisation Against Torture) have made a joint appeal to the EU to improve the European Union‘s support to human rights defenders. This is done in the form of comments on the new EU Action Plan on Human Rights and Democracy. That there is a need for more cohesion was demonstrated by the recent faux pas of the EU in giving a human rights award to Bahrain which can hardly be in line with the recommendations [see: https://thoolen.wordpress.com/2014/12/11/what-human-rights-day-means-in-bahrain-and-how-the-eu-made-it-worse/].

Effective and meaningful support to HRDs by the EU and its member states should aspire to [excerpts]: I draw attention especially to number 6!

1. Better protect

The EU can achieve better protection of HRDs – including better prevention of the risks associated with their work:

1. Institute a system for the centralised follow-up of all human rights defenders’ cases, and their treatment by the EU and Member states at headquarters and in delegations.

2. Ensure all staff in Delegations in diplomatic missions, and at headquarters, including at the highest level, are aware of the importance of working with and for HRDs, of the EU Guidelines and of the necessity to implement them fully, and of reporting back. Systematically train EU and member states’ staff at all levels on the full implementation of the EU HRD Guidelines;

3. Facilitate emergency measures such as relocation and emergency visas for HRDs, and ensure all staff are aware of procedures. Ensure the facilitation of visas for HRDs visiting decision-makers in the EU and member states in order to reinforce meaningful exchanges on how to support their vital work;

4. Monitor and provide systematic feedback to HRDs, civil society and the public on EU and member states’ actions on HRDs, encouraging meaningful public debate on how to reinforce their vital efforts;

5. Assist and support governments and promote participation of local civil society in developing and implementing public policies and mechanisms for the protection of HRDs; and/or in advocating for the amendment or abrogation of restrictive laws; and in the fight against impunity for human rights violations committed against HRDs;

6. Ensure that an annual Foreign Affairs Council meeting is dedicated to discussing EU efforts to pursue the release of HRD, journalists and others who exercise their rights peacefully. Foreign Ministers should adopt conclusions naming jailed rights advocates from around the world and call for their immediate and unconditional release.  Every three months PSC Ambassadors should take stock, in close collaboration with civil society, of EU efforts to pursue the release of jailed HRDs. EU delegations should be requested to clarify efforts they have undertaken, ahead of these meetings;

7. In the spirit of the EU Guidelines on HRDs, the EU and its member states should commit to documenting and reporting on effective best practices in support of HRDs, and working to reproduce them where relevant in future; organise annual regional workshops with civil society to exchange best practices and lessons learned, and build the capacity of HRDs, and of senior EU and member states’ diplomatic staff.

2. Reach out

EU policies in support of HRDs must also go beyond addressing their protection in emergency situations on an ad hoc basis. This means considering HRDs not only as victims of repression, but as key actors of change in their own country who can likewise provide a valuable contribution to the design of both EU and national policies and decision-making…

8. Implement burden-sharing between the EU and Member states, to ensure that human rights defenders in all regions of a country have access to, and contact with, the EU; that the responsibility for particularly logistically challenging tasks such as trial observation, prison visits or contacts with rural areas does not fall only on one diplomatic mission, and that continued buy-in on human rights issues by all is possible;

9. Actively support HRDs through a flexible combination of concrete actions and public diplomacy, on the basis of effective consultation with concerned HRDs, including public intervention whenever this can improve the security of HRDs at risk;

10. Conduct regular visits to HRDs outside large urban centres, and increase outreach to vulnerable, marginalised HRDs and women HRDs;

11. Clearly communicate the human rights priorities of EU country strategies to local HRDs to facilitate their work.

12. Systematically include meetings with HRDs when planning high level visits to third countries (including visits by member states’ representatives and Members of the European Parliament);

13. Translate the Guidelines on HRDs into local languages, and disseminate them amongst civil society, including different ethnic minority groups and indigenous communities.

3. Do no harm

The EU and its member states should evaluate all actions taken in regard to their compliance with human rights, and concretely monitor trade and development policies and programming to ensure they are consistent with EU and member states’ human rights commitments. The EU should offer HRDs recourse in case their human rights or those of the people they defend are violated. The ‘do no harm’ principle should be integrated in other actions foreseen in the revised Strategic Framework and Action Plan (under ‘trade’, ‘development’ etc…), which is why only key actions are proposed here:

14. Ensure the meaningful consultation/participation of HRDs, possibly through the development of a specific format for regular exchanges, in the preparation of EU and member states’ human rights dialogues, strategies, development programming, and in the context of EU trade and investment policy;

15. When debating national policy with third country governments, the EU should strive to facilitate dialogue between governments and HRDs (for example on security, development, health, etc), and ensure inclusion of HRDs and social organisations in decision-making on these issues;

16. Set up a complaint mechanism for HRDs who have become victims of human rights violations in the context of EU and member states’ policies and investments.

What Human Rights Day means in Bahrain and how the EU made it worse

On 9 December, on the eve of Human Rights Day, Zainab Al-Khawaja was sentenced to 4 years and 4 months in two separate court hearings in Bahrain. Front Line, Human Rights First and others have reported extensively on this courageous human rights defenders [see also: https://thoolen.wordpress.com/tag/zainab-al-khawaja/] .

She was sentenced to 16 months’ imprisonment for “sabotaging properties belonging to the Ministry of Interior” and “insulting a public official” to three months’ imprisonment and fined 3,000 Bahraini Dinar (approx. 6,400 Euro) for “tearing up a photograph of the King”.

Frontline NEWlogos-1 condensed version - cropped also shockingly reports that on the same day as her sentencing, the European Union presented a human rights award to Bahrain’s National Institution for Human Rights and the Ombudsman of the Ministry of the Interior! Although this concerns a relatively unknown regional award (the Chaillot Prize is presented annually by the Delegation of the European Union in Riyadh http://www.ambafrance-bh.org/Press-release-Delegation-of-the.) the state press has been making the best of it [http://www.gulf-daily-news.com/NewsDetails.aspx?storyid=391213] and it is hard to see this as in line with the EU policy on Human Rights Defenders.

Why Maryam Al-Khawaja boycotted the Bahraini court on 1 December

As a human rights defender, I, Maryam Al-Khawaja, Director of Advocacy at the Gulf Center for Human Rights, have decided to boycott my court hearing on the 1 December 2014. During this hearing I am due to be sentenced on trumped up charges of assaulting two policewomen at the Bahrain International Airport. (Update: Al-Khawaja was sentenced to one year imprisonment on 1 December)

The decision to boycott the court was reached based on several grounds:

  • The lack of independence and due process in the Bahrain judiciary system:

It has become evidently clear that it is not possible to have a fair and independent trial in Bahraini courts as they stand. The judicial system in Bahrain is highly flawed, and is overrun with egregious human rights violations which usually start during the arrest, and continue throughout what is supposed to be a legal process. I was personally subjected to numerous human rights violations since the moment of arriving in Bahrain and until I was able to leave the country as can be read in my testimony here.

There are medical reports about the injuries I sustained during the assault I was subjected to, for which I continue to need physiotherapy. My case was sped up, and quickly turned for sentencing with complete disregard to legal procedures.

  • The lack of independency and neutrality of the judge himself:

The presiding judge, Mohammed Ali Alkhalifa, in the case brought against me is a member of the ruling family, and has been himself, as well as members of his family, identified previously during my advocacy campaigns as implicated in human rights violations. This makes his presiding over the case a clear case of conflict of interest given the personal grievances he may have against me. This judge in particular, it is important to note, has been involved in the sentencing of numerous human rights defenders including Nabeel Rajab and Naji Fateel in unfair trials.

  • The cooperation of the Special Investigations Unit (SIU) with the Ministry of Interior:

During my imprisonment I met with the SIU, headed by Nawaf Hamza, to submit a complaint against the three policewomen and the first lieutenant who assaulted me at the airport. The prosecutor, Mohammed Al-Hazaa, rewrote my statement in his own words, attempting to implicate me in violations, and refused to correct what he had misquoted. This resulted in my refusal to sign the papers and filing of a complaint against the prosecutor. One day before the sentencing, namely on the 30th of November 2014, and due to almost daily follow up by my lawyer, the public prosecution notified him that the complaint case had been revoked. Despite my complaint about the assault since the beginning of my arrest, it was only one day before the sentencing that my lawyer was finally able to get a statement from the public prosecution that my complaint case had been revoked, at a time when the trumped up assault charges against myself were speedily processed and turned for sentencing.

  • The violation of my rights by the public prosecution:

During the interrogation I was subjected to, I was refused access to my lawyer by the prosecutor dealing with my case. During my imprisonment my lawyer was not given any visits, nor was the Danish embassy. The way that the public prosecution deals with politically motivated cases is it uses all aspects of the government to provide impunity for the perpetrators of violations.

Based on the reasons stated above, I find any and all cooperation with the court or attendance of the hearings by myself as a problematic legitimisation of an unfair and biased court. Therefore I have decided to boycott the hearings, and have asked my lawyer to do the same.

It is important to note here, if I, as a human rights defender, whose case receives international media and diplomatic attention is handled in this way; it is gravely concerning how cases not receiving attention are handled by the authorities in Bahrain.

Special Rapporteur on HRDs in first address to General Assembly: Combat reprisals and protect human rights defenders

The need to combat impunity for attacks against human rights defenders, together with the enactment of specific laws and policies to protect their work, have been identified as key priorities by the new UN Special Rapporteur on Human Rights Defenders, Michel Forst, in his inaugural report to the UN General Assembly next week. This is stated by the International Service for Human Rights in Geneva.
 

The report, which will be presented to the General Assembly in New York in the week of 20 October, sets out a vision and priorities for the mandate over the coming three years, including a focus on groups of human rights defenders who are ‘most exposed’ or at risk, such as those working to promote economic, social and cultural rights, the rights of minorities, the rights of lesbian, gay, bisexual, transgender and intersex persons, women human rights defenders, and those working on issues of business and human rights or on accountability for past violations. According to the Special Rapporteur, each of his ‘future thematic and mission reports will contain a specific section dedicated to analysing the development of trends and particular threats facing the most exposed groups’.

The report expresses grave concern at the related issues of lack of cooperation with the mandate by some States, and the intimidation and reprisals faced by many human rights defenders in connection with their engagement with international and regional human rights mechanisms. The Special Rapporteur is ‘struck by the number and gravity of threats’ against those who cooperate with the UN, the report says, including ‘threats against the defenders themselves or their families, defamation campaigns, death threats, physical violence, abductions, hounding by law enforcement, assassinations or various forms of harassment and intimidation by the police’. In this connection, the Special Rapporteur pledges to follow-up more actively and systematically with States in relation to the investigation and remediation of alleged threats and attacks against defenders.

The need to ensure accountability and combat impunity for attacks against defenders comes through as a strong theme in the Special Rapporteur’s report, with Mr Forst identifying that ‘it is partially because of the de facto impunity enjoyed by perpetrators of reprisals against defenders that the phenomenon grows and expands’ and pledging that ‘one of the main lines of his work will be to combat the culture of impunity’. It is likely that the Special Rapporteur will dedicate a forthcoming report to this topic.[for examples see: https://thoolen.wordpress.com/tag/reprisals/]

Building on the recommendation of the previous Special Rapporteur that States enact specific laws and policies to protect human rights defenders, Mr Forst’s inaugural report identifies a need to ‘intensify efforts to convince governments to develop specific national measures, following the examples of Brazil, Colombia, Cote d’Ivoire and Mexico’ and foreshadows a future study focusing on the importance of national laws and mechanisms and ways to improve their effectiveness. He also pledges to play a significant role in the identification and dissemination of ‘good practices’ in the implementation of the Declaration of Human Rights Defenders, including through a more visible social media presence for the mandate.

Finally, the Special Rapporteur identifies a need to further intensify cooperation with other UN mandate holders, together with the Special Rapporteurs on Human Rights Defenders appointed by regional mechanisms, including the African Commission on Human and Peoples’ Rights and the Inter-American Commission on Human Rights. In this regard, it is notable that the Special Rapporteur has already issued joint statements with other mandate holders, such as the Special Rapporteurs on Freedom of Expression and Freedom of Association and Assembly, on issues including the detention of Bahraini human rights defender Maryam Al-Khawaja, the use of anti-terrorism legislation to criminalise human rights defenders in Ethiopia, and the passage of draconian anti-protest legislation in the Australian state of Tasmania.

Bahrain sets October 1 trial date for Maryam al-Khawaja

AFP reports from Dubai that Bahraini human rights defender Maryam al-Khawaja is to stand trial from October 1 charged with assaulting a police officer. Her lawyer Mohammed al-Jishi told AFP the prosecutor general had also decided to extend her custody pending the trial. A conviction could carry a five-year prison sentence, he said. Khawaja, a director of the Gulf Centre for Human Rights who also has Danish nationality, was arrested after arriving at Manama airport on August 30.

Human Rights First disappointed by Nomination of new Ambassador to Bahrain
