Shocking case of refoulement from Spain

On 30 March 2022, Statewatch along with 13 other human rights organisations condemned the deportation from Spain to Algeria of Mohamed Benhalima, a human rights activist who faces a serious risk of torture and other ill-treatment in the North African state.

The organisations strongly condemn the deportation by Spain of Algerian activist Mohamed Benhalima, in the evening of 24 March 2022, despite the risks of torture and serious human rights violations he faces in Algeria, and therefore in blatant violation of Spain’s international obligations on non-refoulement. The authorities had been made aware, through civil society and legal appeals, that Mr Benhalima faces a high risk of torture, arbitrary detention and unfair trial in Algeria, where such violations are increasingly common against prisoners of opinion and peaceful activists.

Mohamed Benhalima is an Algerian citizen and a former Army corporal turned whistleblower, who exposed corruption among Algeria’s high-ranking military officials in 2019. He left Algeria after receiving information that his name was on a list of wanted military officials at risk of detention by the Algerian army for their participation in the Hirak, a mass pro-democracy protest movement.

He sought asylum in Spain on 18 February 2020 and again on 18 March 2022; Spain refused him asylum both times. On 14 March 2022, authorities opened an administrative file of expulsion for infringement of Art. 54.1.a. of Immigration Law 4/2000, alleging that Mr. Benhalima took part in “activities contrary to public security or which may be harmful for Spanish relationships with foreign states”.

Spanish authorities justified the opening of an expulsion file based on Mr. Benhalima’s alleged association with political opposition group Rachad, which was listed as a terrorist group by Algeria on 6 February 2022. Spanish authorities claimed that Rachad’s objective was to infiltrate radical youth into Algerian society to protest against the Algerian government, and concluded that the activist was a member of a terrorist group.

Authorities did not provide any proof of violent action or speech or any other action taken by the activist that would fall under a definition of terrorism in accordance with the definition proposed by the UN Special Rapporteur on the protection of human rights while countering terrorism. Authorities also do not appear to have considered a context in which Algerian authorities have been increasingly levelling bogus terrorism and state security charges against peaceful activists, human rights defenders and journalists since April 2021. On 27 December 2021, UN Special Procedures warned that the definition of terrorism in the Algerian Penal Code was too imprecise and undermined fundamental rights. They stated that the procedure for registration on the national terrorist list did not comply with international human rights standards and expressed concern that it could give rise to abuse.

On 24 March around 7pm, Mr. Benhalima’s lawyers were notified of the resolution of expulsion and promptly filed a request for an interim suspensive measure at the National Court of Spain, which was rejected; however, it was revealed later that the activist was already on his way to Algeria at the time.

On 21 March 2022, the UN High Commissioner for Refugees (UNHCR) submitted a non-public report to the Spanish government stating that Mr. Benhalima’s asylum request should be studied thoroughly in a regular procedure and not rejected expediently, arguing that the fear of torture was credible and that Algeria’s criminalisation of peaceful opposition was internationally recognised.

On 27 March, Benhalima appeared in a video broadcasted on Ennahar TV, in which he “confesses” to the crimes of conspiracy against the state, and states that he was not treated badly in custody. However, the undersigned organisations call into question the reliability of such statements which might be the result of duress. In addition, Benhalima had himself released a video from the retention centre in Valencia, before his deportation to Algeria, in which he warns that such videos would not be genuine and would show that he “was subjected to severe torture at the hands of intelligence services.”

In January and March 2021, in Algeria, Mohamed Benhalima was sentenced in absentia to a total of 20 years in prison for charges including “participation in a terrorist group” (Article 87bis 3 of the Penal Code) and “publishing fake news undermining national unity” (Art.196 bis) among other charges. The overly broad formulation of both articles has been used by Algeria repeatedly to criminalise fundamental freedoms. In one of the verdicts, issued on 9 March 2021, the judge sentenced Benhalima to 10 years in prison for his online publications, including videos exposing corruption in the army, a form of peaceful expression, which is protected under the right to freedom of expression.

Spanish authorities additionally motivated the expulsion based on Mr. Benhalima’s close relationship with Mohamed Abdellah, another Algerian whistleblower and former member of the military, who also sought refuge in Spain in April 2019 and was forcibly returned on 21 August 2021 using Art. 54.1.a. of Law 4/2000, in similar circumstances and for the same motives.

Mohamed Abdellah, currently detained in the military prison of Blida, stated in court on 2 January 2022 that he had been subjected to various forms of torture and ill-treatment upon his return to Algeria, including prolonged solitary confinement in a cell with no light and physical abuse, according to a witness who attended the hearing. He was also deprived of access to a lawyer.

Despite the strong similarities between both cases providing a compelling precedent about the actual risk of torture and ill treatment of activists and whistleblowers, notably former members of the military, in Algeria, the Spanish government showed its determination to forcibly return someone where their physical and psychological integrity was not guaranteed. In doing so, Spain flouted critical international law obligations under which nobody should be returned to a country where they would be in danger of suffering torture or other cruel, inhuman or degrading treatment.

20 Years later, Guantanamo’s legacy still there

On the 20th anniversary of Guantanamo Bay Kasmira Jefford of Geneva Solutions looks at the legacy of the so-called “war on terror”. She does so in conversation with UN special rapporteur Fionnuala Ní Aoláin on the promotion and protection of human rights and fundamental freedoms while countering terrorism. From camps in north-eastern Syria, where thousands are detained without legal processes, to China where detention camps are posing under the guise of “education facilities” – secret detentions and enforced disappearances are still happening every day under the banner countering terrorism. Here some lengthy extracts:

In 2010, UN experts from four different working groups and special procedures joined forces to produce one of the most comprehensive studies to date on widespread systematic torture, enforced disappearances, arbitrary detention and secret detentions taking place across the world and condemning the wide range of human rights violations committed by countries.

In a follow-up report presented on Wednesday at the Human Rights Council 49th session, the special rapporteur said 10 years on, these practices are still rife and deplored the “abject failure” by states to implement the recommendations of the 2010 study.

GS News: In 2010, UN experts published a milestone study on secret detentions. What does your follow-up report show?

Fionnuala Ni Aolain: The 2010 report was unusual because it involved… four special procedure mechanisms coming together and identifying each in their collective way the scale of the problem of systematic torture and rendition of persons across borders, and systematic disappearances, arbitrary detention, and secret detentions. The [follow-up] report we’ve just published does a stock-taking and assesses whether or not the recommendations of the special experts were implemented. And possibly the single most depressing thing about that review is that the annex lists every single person who was named in the 2010 report – hundreds of names who were rendered, tortured, or both – and not a single individual received an adequate remedy [for the violation of human rights they experiend]. There was no accountability, no person was ever charged with crime for any of those acts.

The second part of the follow up report focuses on what that culture of impunity enabled. And what I find is that the culture of impunity, fostered and enabled by the “war on terror” as it was called essentially has created and enabled the conditions in which other places of mass detention have emerged. The report focuses on two of them : Xinjiang, China, and the situation in [in detention camps] in northeast Syria.

One of the observations you make is that ‘secret’ detention has evolved in the past two decades to encompass more complex forms of “formally lawful” or legalised transfer. Can you explain?

In the evolution that we’ve seen…dark-of-night arrivals into places like Poland and Lithuania and other countries that were accepting these rendition flights stopped because the global heat, if you want, on that kind of rendition was simply too high. It just became intolerable and unacceptable for states who were cooperating in enabling torture and rendition to continue to do it. But there’s been this transition into this ‘lawful transfer’. These are diplomatic assurances, [for example], where one state offers an assurance to another state that they will not torture the person who’s transferred into their custody.

But as the report makes clear, if you have to provide an assurance that you’re not going to do that, it tells you that there’s something fundamentally dysfunctional about the legal system that’s producing the assurance  – and there’s a fundamental question about the trustworthiness of the assurance if it happens. And what we know in practice is that so many of those assurances are not worth the paper they are written on. People have had the worst kinds of practices meted out to them under the cover of diplomatic assurance. And there have been no consequences for states in breaking those assurances.

One of the issues you raise in the report is the lack of a globally agreed definition on terrorism or acts of terrorism. Why has it been so complex to agree upon a definition?

Part of what happened is that 9/11 spawned this culture where everybody agree that terrorism was a bad thing but nobody ever defined it. …What we see in practice is the systemic abuse of counterterrorism across the globe. We see it in multiple countries. Over 67 per cent of all the communications the mandate has sent since 2005 have involved the use of a counterterrorism measure against a civil society actor. So this tells you that actually, they’re doing really bad counterterrorism.

We have to understand that, in fact, there’s a structural endemic problem. And in many countries, states’ security is governed by counterterrorism. The example I often use is the Kingdom of Saudi Arabia, when women’s rights activist Loujain al-Hathloul was jailed on terrorism charges and processed through a Special Criminal Court. So this shows terrorism being everything and nothing.

In your annual report presented to the General Assembly in October last year, you said that efforts to improve counter terrorism measures are in fact damaging human rights. Would you say that counterterrorism is incompatible with the respect of human rights?

Security is a human right. It’s found in the Universal Declaration on Human Rights. Our most fundamental right that enables us to have other rights is the right to be secure. So I don’t think they’re incompatible and I don’t think the drafters of the Universal Declaration thought they were incompatible. I grew up in Northern Ireland in a society which was, in many ways, defined for decades by counterterrorism law. The problem is that expansive counterterrorism law, which is what we have, is imprecise – and vague counterterrorism law is fundamentally incompatible with the rule of law.

The fundamental idea contained in the rule of law is that if you are to be charged with an offence by the state, that you know precisely what acts you engaged in that are likely to make you subject to the course of power of the state. And the fundamental problem with terrorism is that it really, in so many countries, kind of injures that the concept of the rule of law, because it’s not precise. A reasonable individual could not know what kind of actions they would engage in would implicate the use of a state or measure against them. So I don’t think it’s incompatible but unfortunately, we have very few examples of good practice.

One of the key examples you highlight in your report are the camps in northeast Syria where thousands of people – the majority women and children – are being detained. You describe this as “a human rights black hole”. What can or should be done immediately for these people who are living in desperate situations?

You have thousands, almost over 60,000 men and  women being held in detention centres, prisons, who have never been through any legal process; the idea that we would hold people in these conditions is simply abhorrent. And then we turn to look at the conditions in those camps. The special rapporteur on torture and I have found that the conditions in the camps reach the threshold of torture, inhumane, and degrading treatment under international law. So the fact that they are there is also unacceptable. But the bottom line is that we have states, mostly western states, who simply will not take back their nationals including children, who refuse.

So, there’s a large-scale political solution that’s required to fix the challenge in northeast Syria, which involves all of the significant parties to the conflict. However, in the short run, the only international law compliance solution to the situation in these camps is the return of women and children to their countries of nationality. We have some states who have made active and ongoing efforts to do so and some who have made no effort.

Human Rights Defenders Targeted By Israel Launch new joint website

On 14 December 2021 the 6 Palestinian civil society organizations targeted by the Israeli government alongside partners have today launched a new website www.PalCivilSociety.com as part of their #StandWithThe6 campaign. This follows Israel’s escalation of its systemic efforts to shrink civic space, defund, criminalize human rights defenders (HRDs) and civil society. In spite of international condemnation, Israel continues to maintain its unlawful designation.

The website consolidates the efforts of the six Palestinian CSOs and partners, and provides resources for supporters outlining the full context of Israel’s ongoing harassment campaigns to silence and diminish Palestinian civil society overall. The website will be a central space where supporters can mobilize in solidarity with civil society, starting by sending emails to US Secretary of State, Anthony Blinken, and Josep Borrell, High Representative of the European Union for Foreign Affairs and Security Policy asking them to take decisive action to force Israel to reverse the unlawful designation.

As jointly stated by the six organizations, “this designation is only the latest of a series of attacks against us and certainly won’t be the last. This continued assault on Palestinian human rights defenders is also accompanied by systematic use of cybersurveillance technology to hack our phones and surveil us. It’s clear that Israel’s intention is to silence and harass Palestinian human rights defenders who criticize Israel’s apartheid and settler-colonial regime and call for holding Israeli authorities accountable for their human rights violations, war crimes and crimes against humanity. Assault by Israel on Palestinian human rights NGOs

As if the fight against terrorists is not already complex enough, Israel has muddied the water more by accusing six prominent Palestinian human rights groups of being terrorist organisations, saying they have undercover links to a militant movement. Not surprisingly. most of the groups document alleged human rights violations by Israel and the Palestinian Authority.

The six are Al-Haq, a human rights group founded in 1979, [and the winner of 5 human rights awards, see: https://www.trueheroesfilms.org/thedigest/laureates/0F74BF45-72C4-9FDD-F96D-2B87BF6C7728] Addameer, Defence for Children International – Palestine, the Bisan Center for Research and Development, the Union of Palestinian Women’s Committees and the Union of Agricultural Work Committees.

The Israeli defence ministry said they were linked to the Popular Front for the Liberation of Palestine (PFLP), a secular political movement with an armed wing that in the past carried out attacks against Israel. The groups “were active under the cover of civil society organisations, but in practice belong and constitute an arm of the [PFLP] leadership, the main activity of which is the liberation of Palestine and destruction of Israel”, the defence ministry said. It claimed they were “controlled by senior leaders” of the PFLP and employed its members, including some who had “participated in terror activity”. The groups serve as a “central source” of financing for the PFLP and had received “large sums of money from European countries and international organisations”, the defence ministry said.

The groups, well known for their human rights work, have indeed quite openly received funding from EU member states, the United Nations and other donors.

Shawan Jabarin, the director of Al-Haq, said the move was an attempt to stifle criticism. “They may be able to close us down. They can seize our funding. They can arrest us. But they cannot stop our firm and unshakeable belief that this occupation must be held accountable for its crimes,he told the Times of Israel.

The Israeli human rights group B’Tselem called the government’s declaration “an act characteristic of totalitarian regimes, with the clear purpose of shutting down these organisations”. It added: “B’Tselem stands in solidarity with our Palestinian colleagues, is proud of our joint work over the years and is steadfast to continue so.”

Human Rights Watch and Amnesty International, who work closely with many of these groups, said in a joint statement:

This appalling and unjust decision is an attack by the Israeli government on the international human rights movement. For decades, Israeli authorities have systematically sought to muzzle human rights monitoring and punish those who criticize its repressive rule over Palestinians. While staff members of our organizations have faced deportation and travel bans, Palestinian human rights defenders have always borne the brunt of the repression. This decision is an alarming escalation that threatens to shut down the work of Palestine’s most prominent civil society organizations. The decades-long failure of the international community to challenge grave Israeli human rights abuses and impose meaningful consequences for them has emboldened Israeli authorities to act in this brazen manner.

How the international community responds will be a true test of its resolve to protect human rights defenders. We are proud to work with our Palestinian partners and have been doing so for decades. They represent the best of global civil society. We stand with them in challenging this outrageous decision.

The US Department of State spokesperson Ned Price said his office had not been given advance warning of the designation. “We will be engaging our Israeli partners for more information regarding the basis for the designation,” Price said on a telephone briefing with reporters in Washington.

The move by the Israeli government represents a challenge for the many European countries that provide financing to the six organizations, European governments, .. now risk being accused of funding terrorism if they continue financing the six groups. One senior European official working in the region admitted the move was likely aimed at putting pressure on donors’ decision-making but said there needed to be an analysis of any evidence put forward by Israel, said CNN Europe.

Post 9/11: where did ‘human rights’ go?

Two full decades have elapsed since the 11 September 2001 terrorist attacks on New York City and Washington, D.C. In the aftermath of these events, the world has entered a period characterised by a number of dynamics, which have persisted and shaped significantly the configuration of the global order. What is the nature of these transformations, notably the militarisation of international relations, the securitisation of social affairs, the rise of cultural and religious tensions and the crisis of democracy? Has the post-COVID-19 moment in turn ushered the end of the post-11 September world? Ultimately, what historical meaning can we ascribe to legacy of ‘9/11’?

Mohammad-Mahmoud Ould Mohamedou is Professor of International History and Politics, and Chair of the Department of International History and Politics at the Graduate Institute. Previously the Associate Director of the Programme on Humanitarian Policy and Conflict Research at Harvard University, he is the author of a trilogy on the post-11 September era and recipient of the 2021 International Studies Association (ISA) Global South Distinguished Scholar Award.

On cue Imogen Foulkes wrote on 7 September 2021 a post for Swissinfo “When the world became a ‘human rights free zone’ September 11, 2001″.

No one will forget the shock of that day. It’s hard even now, two decades later, to describe how it felt to watch something so unimaginable, so horrific. When I returned to my newsroom that evening, a colleague said to me “well, Imogen, that’s it, our world has changed forever”. I was still so focused on the immediate event that I didn’t quite understand him, and it took me a while to realise how right he was.

Our world did change forever that day; from smaller inconveniences around how we travel, to fears over how safe we are, to prejudices and intolerance towards groups perceived as a threat, to sweeping changes in security laws.

In the latest episode of our Inside Geneva podcast, we look at those changes, and the consequences, in particular for human rights. Gerald Staberock, secretary general of the World Organisation Against Torture, tells me: “I want my government to fight terrorism. I want those who did 9/11 or whatever terrorist attacks to be brought to justice.” But he also regrets the fact that the 9/11 attacks, which he describes as “a denial of the very values of human rights”, led to – in his view – “another attack on human rights, through counterterrorism”. 

Looking back now, with all the knowledge we have of extraordinary rendition, Guantanamo Bay, waterboarding and so on, it is quite hard to remember that in the first months and even years after 9/11, none of us, not even human rights defenders, were quite aware of how the “war on terror” was being fought.

Once that war was being conducted in earnest in Afghanistan, I remember getting a hint, off the record, from the International Committee of the Red Cross (ICRC), who told me that they were aware of detainees being transferred from Bagram airbase, but had no idea where they were being taken. It is the ICRC’s role, under the Geneva Conventions, to visit those detained during conflict, a role which was, for a while at least, impossible to fulfil.

Fionnuala ní Aoláin, currently UN special rapporteur on human rights and counterterrorism, also joins us on the podcast. Her position, she points out, was not created until five years after 9/11, and, she says “in that absence lies the story of a human rights free zone”, during which “the United States moved to engage in practices of torture, of rendition, or the establishment of a black hole where people were held arbitrarily”. 

Governments have argued that extraordinary measures are necessary to counter extraordinary threats. Certainly no political leader wants a 9/11 type attack on his or her watch. And, many opinion polls show, the public are prepared to compromise some fundamental human rights standards in the name of defeating terrorism.

A 2016 study by the ICRC found that, among millennials in industrialised countries, many agreed that torture was justified if it led to information that could save lives. Strikingly, among young people living in conflict zones, or under repressive regimes, a large majority remained opposed to torture.

This shift in opinion is a concern for ní Aoláin, who points out that some governments have taken to justifying increasingly repressive laws in the name of the war on terror. “Right now, in…Saudi Arabia, Turkey, Egypt, we see governments saying that human rights defenders are terrorists, that eco warriors are terrorists, that women’s rights defenders are terrorists.”

Interestingly, ní Aoláin comes from Belfast. She grew up with terror attacks, and counterterrorism measures. She believes that “actually it is counterproductive to security to violate human rights”, a point of view Staberock agrees with. He remembers research done in Northern Ireland in which senior security officers admitted that preventive detention had been a disaster, not just from a human rights perspective, but from a security perspective because “it made the cause much broader, it made the problem much bigger…by victimising people, you weaken the cause”.

Both ní Aoláin and Staberock believe the term “terrorist” is too widely used, and that it can become a convenient slogan for governments to introduce all sorts of legislation which would otherwise not easily be justifiable.

Staberock argues that “the best answer to terrorism is to demask it as killings. Not allow it to hide behind ideology. Demask it in an ordinary criminal process, bring people to justice, punish them, stick to your rules”.

The first shots in the war on terror were fired, 20 years ago, in Afghanistan. Today, in that same country, we are watching a humanitarian and foreign policy disaster unfold. As western diplomats made a panicked dash for the airport, they left millions of Afghans to live, again, under the Taliban, the very “terrorist” group the US and its allies entered Afghanistan to defeat.

So have we learned anything from the last 20 years? Do listen to Inside Geneva to find out more, but I’ll leave you with these final thoughts from ní Aoláin.

“We appear not to have learnt any lessons,” she says. “What we appear to be doing is betraying civil society, leaving women, human rights defenders and girls…when we conveniently decide that we’ve had enough and it’s time for us to leave.”

But, as a human rights defender herself, she is not deterred: “If you fight for human rights you’re always pushing big rocks up mountains, and you watch them fall down, and you push the same rocks up the mountain again. I think those of who work on human rights in the context of counterterrorism are looking at an enormous big rock.”

Stansted 15 convictions quashed: “No case to answer”

The Court of Appeal held on Friday 29 January 2021 that a group of activists who broke into Stansted Airport in an act of protest should “never have been prosecuted” for an “extremely serious” terror-related offence under s.1(2)(b) of the Aviation and Maritime Security Act 1990 (“AMSA”).

It overturned the Stansted 15’s convictions.

Lord Burnett said the protestors should not have been prosecuted for the extremely serious offence … because their conduct did not satisfy the various elements of the offence. “There was, in truth, no case to answer.

This case has been controversial, drawing attention both nationally and internationally. Following the initial convictions, a joint letter was sent to the Government by UN experts, including the Working Group on Arbitrary Detention, the Special Rapporteur in the promotion and protection of the right to freedom of opinion and expression, the Special Rapporteur on human rights defenders, and the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms when countering terrorism. The UN experts urged the UK government not to use security and terrorism-related legislation to prosecute peaceful protesters.

The failure of the ground relating to necessity, duress and s.3 CLA are unlikely to surprise those with experience of defending protestors in direct action cases. Nevertheless, it is notable that the actions of the appellants did prevent the deportation of five persons on the flight who have consequently been able to establish their legal right to remain in the UK, including three on human rights grounds. One of those has been granted asylum as a victim of human trafficking. In total, of the 60 persons due to be on the deportation flight, eleven reportedly remain in the country.

Amongst the human rights group who have celebrated the ruling are Amnesty UK, who welcomed “a good day for justice” and Liberty, who hailed “a major victory for protest rights” and deprecated the now-quashed convictions, calling them “part of a sustained attack on the right to protest.”

EU human rights committee condemns India’s arrest of human rights defenders

20 May 2020 the chairperson of the Subcommittee of Human Rights of the European Parliament sent a letter to Indian Home Minister Amit Shah, condemning the arrest of human rights defenders under the Unlawful Activities (Prevention) Act.

In her letter, Maria Arena said the European body has been closely following the arrests of human rights defenders Anand Teltumbde and Gautam Navlakha by the National Investigative Agency in India.

Academic and Dalit author Teltumbde and human rights defender Navlakha had surrendered to the police last month after exhausting their possible legal remedies.

Nine other defenders have been in jail since 2018 in the Bhima Koregaon case, where the charges relate to caste violence around an Ambedkarite event and an alleged Maoist plot to foment armed revolution and possibly assassinate Prime Minister Narendra Modi.

In 2018, the United Nations’ Office of the High Commissioner for Human Rights had issued a statement against terror charges being invoked against the activists.

It is particularly alarming to note that human rights defenders cannot conduct advocacy activities, notably in favor of India’s poorest and most marginalised communities, without becoming subject to intimidation and harassment,” Arena said in her letter.

Equally worrying is the fact that terrorism charges, including under the Unlawful Activities Prevention Act (UAPA) have been used to silence them,” she noted pointing out that by United Nations Special Procedures, this clearly represents a violation of international human rights standards.

The letter further stated that to date, the European Parliament had noted that various forms of legitimate peaceful protests against laws, policies and governmental actions, including the Citizenship Amendment Act, had been portrayed as terrorist activities under this legislation, resulting in a number of arrests. This is notably the case for human rights activists such as Safoora Zargar, Gulfisha Fatima, Khalid Saifi, Meeran Haider, Shifa-Ur-Rehman, Dr Kafeel Khan, Asif Iqbal and Sharjeel Imam, who were recently arrested by the police,” the letter noted.

Against this background, there are also increased fears that the legislation might confer discretionary powers upon state agencies. India, she said, should do much more to ensure a safe and conducive environment for civil society working in the country and consider enacting a law on the protection and promotion of human rights defenders.

Over the past month, ProtectDefenders.eu has received a considerable and growing number of reports regarding attacks, threats, and alerts affecting human rights defenders in India. This information alerts to the numerous acts of police and judicial harassment in the repression of legitimate activities in favor of human rights. Among other incidents, police harassment and arbitrary detention of human rights defenders were reported in Manipur State, in relation to statements made to criticise the management of the current COVID-19 pandemic by local authorities.

Moreover, the Paris-based International Federation for Human Rights has written to Prime Minister Narendra Modi and home minister Amit Shah terming the detentions of several Indian human rights activists ‘arbitrary’. It says the activists have been arrested for “their participation in peaceful protests against the Citizenship Amendment Act 2019 (CAA)” in the last few months.

The letter highlights the cases of Devangana Kalita and Natasha Narwal, student activists who have been associated with the anti-CAA protests in Delhi and were arrested recently by the Delhi police.

Novelty in the Philippines: National Council of Churches listed as terrorist group

On 22 November 2019 the National Council of Churches (NCCP) issued a press release after the Department of National Defense of the Philippines has included the NCCP in the list of “front organizations of local communist terrorist groups”. In adition to the NCCP, a number of humanitarian and service-oriented organizations were placed on this list, which was presented by Major General Reuben Basiao, Armed Forces of the Philippines Deputy Chief of Staff for Intelligence, on 5 November. In the statement, the NCCP “decries the baseless and unfounded inclusion of its name in the list […] and respectfully call on the government to seriously review and revisit the accusations and engage in peace building instead”. “We recognize the clear threat that is now posed to the NCCP staff, member churches, associate members, and other ecumenical partners”, they said in a letter the NCCP sent to its partners last week. The NCCP also warned that “the red-tagging will delay, or even prevent, the delivery of much-needed services to marginalized communities in the midst of disasters. On a larger scale, this will further shrink the already limited civil space”.
In June 2019, the Philippine government rejected the United Nations call for an investigation into human rights violations for the government’s policies against drug trafficking, arguing that it was an “interference”. [see: https://humanrightsdefenders.blog/2019/07/11/un-council-agrees-action-on-philippines-in-spite-of-vehement-objection/]. According to official figures, 5,300 suspects have been killed by the police since 2016. But according to human rights defenders, the figure would be three times higher. The NCCP explained in the letter to its partners that “within the past few days, we have witnessed attacks against civil society organizations that are critical of the government’s policies and programs. There have been raids, illegal arrests, and vilification. Before this of course, there were even killings of activists and human rights defenders”. “The NCCP deems these moves as desperate attempts by the authorities to criminalize dissent and to weaponize the law against the people”, it said.
The government action has been widely condemned by several international Christian leaders. Rev. Olav Fyse Tveit, World Council of Churches General Secretary, said “red tagging in effect gives a green light to harassment and deadly attacks by security forces and militias against those listed”. Similar statements have been released by the Christian Conference of Asia, the Action of Churches Together Alliance, Christian Aid, and the Evangelical Lutheran Church in Northern Germany, among others. Founded in 1963, the NCCP is an ecumenical federation of churches of non-Roman Catholic denominations.

Human Rights and Counter-Terrorism issues at the UN

For states to treat Egypt as a reliable partner by allowing it joint leadership on the UN resolutions on human rights and terrorism only helps to provide cover for and perpetuate this egregious pattern, with serious consequences for the lives and dignity of Egyptians seeking to exercise their fundamental rights. The 74th session of the UN General Assembly Third Committee is an important opportunity for states to not only end their misguided acquiescence in Egyptian efforts to undermine UN work on terrorism and human rights, but also to restore the long legacy of Mexican leadership on the resolutions. In addition to the reasons identified in Saul’s Lawfare piece (which we won’t repeat here), several factors make this particular General Assembly resolution potentially an even more impactful moment.

In this moment, member states should recognize that a continuation of a Mexico-Egypt merged resolution on “terrorism and human rights” holds no promise of positive results for human rights. Now is the time for UN members to turn the tables and take a principled and strategic position: if Egypt will not agree to restoring key normative provisions previously lost, vigorously reinforcing rather than eroding support for the existing focus of the Special Rapporteur mandate, and laying the appropriate groundwork for a strong GCTS review in 2020, then states should insist that the merger be brought to an end and go back to the consensus text of resolution A/72/180.

Keeping Human Rights and Counter-Terrorism in Focus at the UN

Result of the 42nd session of the UN Human Rights Council

On 27 September 2019 a group of civil society organisations welcomed significant outcomes of the HRC’s 42nd session, including reaffirming its condemnation of reprisals and extending its scrutiny over Yemen, Venezuela, Cambodia, Burundi, Myanmar, and Sudan. This session witnessed heightened scrutiny of Council members by shedding light on the situation in Saudi Arabia, but it missed an opportunity to ensure scrutiny over situations in China, Kashmir and Egypt. The 42nd session also advanced standards on several issues including the right to privacy, administration of justice and the death penalty, but failed to defend the mandate of the Special Rapporteur on counter-terrorism against attempts to dilute and distract its focus. The High Commissioner failed again to present the database on companies facilitating Israel’s illegal settlements.

The Council reaffirmed that reprisals can never be justified. Council members rejected attempts to weaken the text including deleting the references to the roles of the Assistant Secretary-General and the Human Rights Council Presidents. [https://humanrightsdefenders.blog/2019/09/23/andrew-gilmours-2019-report-on-reprisals-it-gets-worse-but-response-remains-mostly-rhetoric/] The resolution listed key trends such as the patterns of reprisals, increasing self-censorship, the use of national security arguments and counter-terrorism strategies by States as justification for blocking access to the UN, acknowledged the specific risks to individuals in vulnerable situations or belonging to marginalized groups, and called on the UN to implement gender-responsive policies to end reprisals. The Council called on States to combat impunity and to report back to it on how they are preventing reprisals, both online and offline.

They welcome the creation of a Fact-Finding Mission (FFM) on Venezuela as an important step towards accountability for the grave human rights violations documented by the High Commissioner.

They welcome the renewal and strengthening of the mandate of the Group of Eminent Experts on Yemen, sending a clear message to parties to the conflict – and to victims – that accountability is at the center of the mandate, and providing a crucial and much-needed deterrent to further violations and abuses. States should support the recommendations made by the GEE in their recent report, including prohibiting the authorization of transfers of, and refraining from providing, arms that could be used in the conflict to such parties; and clarifying the GEE’s role to collect and preserve evidence of abuses.

They welcome the renewal of the mandate of the Special Rapporteur on Cambodia, but regret that calls to strengthen the mandate of the OHCHR to monitor and report on the situation have been ignored. We regret that the resolution fails to accurately depict the continuing crackdowns on civil society and the severity and scale of recent attacks on the political opposition.

They welcome the renewal of the mandate of the Commission of Inquiry on Burundi. Its work is vital as the country heads towards elections in 2020. The Burundian Government should desist from denial and insults, and should cooperate with the Commission and other UN bodies and mechanisms.

They welcome that the EU and OIC have jointly presented a resolution on Myanmar requesting the High Commissioner to report on the implementation of the recommendations of the Fact-Finding Mission at HRC 45. However, the international community needs to take stronger action to ensure accountability for and cessation of grave international crimes, in particular by referring Myanmar to the ICC and imposing a global arms embargo – and by acting on the FFM’s reports, including those on economic interests of the military and on sexual and gender-based violence in Myanmar and the gendered impact of its ethnic conflicts.

On terrorism and human rights, they are deeply disappointed that Mexico and other States have partially acquiesced in attempts by Egypt to dilute or distract the work of the Special Rapporteur on counter-terrorism away from its appropriate focus on human rights violations while countering terrorism and human rights of victims of terrorism. We regret that States have asked the Special Rapporteur to spend the limited time and resources of the mandate, to comment on the overbroad concept of the “effects” of terrorism, by which Egypt and some other States seem primarily to mean macroeconomic, industrial, and investment impacts, rather than the human rights of individual victims. The length to which States seem willing to put the existing Special Rapporteur’s mandate at risk, in the name of protecting it, while failing even to incorporate stronger consensus text on human rights issues included in the most recent merged parallel resolution at the General Assembly, suggests that the merger of the previous Mexican and Egyptian thematic resolutions no longer holds any real promise of positive results for human rights.

They welcome the Council’s renewed attention to the protection of the right to privacy in the digital age: fully integrating human rights into the design, development and deployment of Artificial Intelligence, machine learning technologies, automated decision-making, and biometric systems, is essential to safeguard not only the right to privacy, but also to freedom of expression, peaceful assembly, and association, and economic social and cultural rights.

On human rights in the administration of justice, we welcome the focus in this year’s resolution on concrete measures to prevent and respond to violence, death and serious injury in situations of deprivation of liberty, which illustrates the potential of thematic resolutions to set out specific practical, legal and policy steps that can be drawn on by governments, civil society, and other stakeholders to have real positive impact at the national level.

They commend Australia for its leadership on Saudi Arabia, as well as the other States who stood up for women’s rights activists and accountability. They urge more States to live up to their commitment to defend civil society and sign the statement in the coming 2 weeks.

For five years since the last joint statement in March 2014, the Council has failed to hold Egypt accountable for continuing systematic and widespread gross human rights violations. In the latest crackdown on peaceful protests, reports indicate that more than 2000 people have been arrested in the past week. When will the Council break its silence and convene a Special Session to address the grave and deteriorating human rights situation in Egypt?

In a resolution (A/HRC/42/L.6) on the composition of staff of the Office of the United Nations High Commissioner for Human Rights, adopted by a vote of 30 in favour, 13 against and four abstentions, the Council requests the United Nations High Commissioner for Human Rights to continue her efforts with a view to redress the current imbalance in the geographical composition of the staff of her Office and requests her to submit a report at the Council’s forty-fifth session.

In a resolution (A/HRC/42/L.16) on the human rights situation in Yemen, adopted by a vote of 22 in favour, 12 against and 11 abstentions, the Council decides to renew the mandate of the Group of Eminent International and Regional Experts for a further period of one year to, inter alia, monitor and report on the situation of human rights and carry out comprehensive investigations into all alleged violations and abuses of international human rights law and all alleged violations of international humanitarian law committed by all parties to the conflict since September 2014. In a resolution (A/HRC/42/L.1) on the human rights to safe drinking water and sanitation, adopted without a vote, the Council decides to extend the mandate of the Special Rapporteur on the human rights to safe drinking water and sanitation for a period of three years and requests the Special Rapporteur to compile good practices at the local, national, regional and international levels in order to promote the progressive realization of the human rights to safe drinking water and sanitation, and to report thereon to the Human Rights Council at its forty-fifth session.

In a resolution (A/HRC/42/L.2) on the role of prevention in the promotion and protection of human rights, adopted without a vote, the Council affirms the importance of effective preventive measures as a part of overall strategies for the promotion and protection of all human rights, and requests the Office of the High Commissioner to prepare a study, to be presented to the Human Rights Council at its forty-fifth session, on the contribution of the special procedures in assisting States and other stakeholders in the prevention of human rights violations and abuses.

In a resolution (A/HRC/42/L.5) on the World Programme for Human Rights Education: adoption of the plan of action for the fourth phase, adopted without a vote, the Council adopts the plan of action for the fourth phase (2020–2024) of the World Programme for Human Rights Education and decides to convene at its forty-eighth session a high-level panel discussion to mark the tenth anniversary of the United Nations Declaration on Human Rights Education and Training, on the theme “The tenth anniversary of the United Nations Declaration on Human Rights Education and Training: good practices, challenges and the way forward”.

In a resolution (A/HRC/42/L.7) on the promotion of a democratic and equitable international order, adopted by a vote of 25 in favour, 14 against and eight abstentions, the Council invites the Independent Expert on the promotion of a democratic and equitable international order to examine the impact of financial and economic policies pursued by international financial institutions on a democratic and equitable international order, in particular those of the World Bank and the International Monetary Fund, and to submit the report to the Human Rights Council at its forty-fifth session.

In a resolution (A/HRC/42/L.8) on the use of mercenaries as a means of violating human rights and impeding the exercise of the right of peoples to self-determination, adopted by a vote of 29 in favour, 14 against and four abstentions, the Council renews for a period of three years the mandate of the Working Group on the use of mercenaries as a means of violating human rights and impeding the exercise of the right of peoples to self-determination, and requests the Working Group to report its findings to the Human Rights Council at its forty-fifth session and to the General Assembly at its seventy-fifth session.

In a resolution (A/HRC/42/L.9) on the Special Rapporteur on contemporary forms of slavery, including its causes and consequences, adopted without a vote, the Council renews the mandate of the Special Rapporteur on contemporary forms of slavery, including its causes and consequences, for a period of three years, and requests the Special Rapporteur to submit reports on the implementation of the mandate to the Human Rights Council and the General Assembly in accordance with their annual programmes of work.

In a resolution (A/HRC/42/L.11) on human rights in the administration of justice, including juvenile justice, adopted without a vote, the Council invites States to take into consideration the issue of human rights in the administration of justice in the context of the Universal Periodic Review and requests the High Commissioner to submit to the Human Rights Council, at its forty-seventh session, an analytical report on human rights in the administration of justice, in particular on current and emerging challenges in the protection of persons deprived of their liberty, including judicial oversight.

In a resolution (A/HRC/42/L.13) on the human rights of older persons, adopted without a vote, the Council decides to extend the mandate of the Independent Expert on the enjoyment of all human rights by older persons for a period of three years, and requests the Secretary-General to ensure that the reports of the Independent Expert are brought to the attention of the Open-ended Working Group on Ageing.

In a resolution (A/HRC/42/L.14) on the right to social security, adopted without a vote, the Council decides to convene, before its forty-fifth session, an intersessional full-day panel discussion on the right to social security in the changing world of work with a view of identifying challenges and best practices. It also requests the High Commissioner for Human Rights to prepare a summary report on the panel discussion and to submit it to the Human Rights Council at its forty-sixth session.

In a resolution (A/HRC/42/L.17) on marking the twenty-fifth anniversary of the Beijing Declaration and Platform for Action, adopted without a vote, the Council decides to convene, during the high-level segment at its forty-third session, a high-level panel discussion to commemorate the twenty-fifth anniversary of the Fourth World Conference on Women, with a particular focus on the implementation of the Beijing Declaration and Platform for Action and the outcome documents of its review conferences, as well as on achievements, best practices and challenges in this regard.

In a resolution (A/HRC/42/L.18) on the right to privacy in the digital age, adopted without a vote, the Council requests the United Nations High Commissioner for Human Rights to organize, before its forty-fourth session, a one-day expert seminar to discuss how artificial intelligence, including profiling, automated decision-making and machine-learning technologies may, without proper safeguards, impact the enjoyment of the right to privacy, to prepare a thematic report on the issue, and to submit it to the Council at its forty-fifth session.

In a resolution (A/HRC/42/L.19) on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, adopted without a vote, the Council decides to extend the mandate of the Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, as established by the Human Rights Council in paragraph 1 of its resolution 6/29, for a further period of three years.

In a resolution (A/HRC/42/L.20) on human rights and transitional justice, adopted without a vote, the Council requests the Office of the United Nations High Commissioner for Human Rights to examine in a report how addressing a legacy of gross violations and abuses of human rights and serious violations of international humanitarian law through transitional justice measures can contribute to sustaining peace and the realization of Sustainable Development Goal 16, and to present the report to the Human Rights Council at its forty-sixth session.

In a resolution (A/HRC/42/L.23) on terrorism and human rights, adopted without a vote, the Council strongly condemns terrorist acts and all acts of violence committed by terrorist groups and the continued systematic and widespread abuses of human rights perpetrated by such groups, and requests States to refrain from providing support to entities or persons involved in terrorist acts, including support in establishing propaganda platforms advocating hatred that constitutes incitement to discrimination, hostility or violence, including through the Internet and other media.

In a resolution (A/HRC/42/L.24) on human rights and indigenous peoples, adopted without a vote, the Council decides to hold an intersessional round table on possible steps to be taken to enhance the participation of indigenous peoples’ representatives and institutions in meetings of the Human Rights Council on issues affecting them, with the full and effective participation of indigenous peoples’ representatives and institutions from the seven indigenous sociocultural regions represented at the thirteenth session of the Expert Mechanism on the Rights of Indigenous Peoples.

In a resolution (A/HRC/42/L.25) on human rights and indigenous peoples: mandate of the Special Rapporteur on the rights of indigenous peoples, adopted without a vote, the Council decides to renew the mandate of the Special Rapporteur on the rights of indigenous peoples for a period of three years to, inter alia, examine ways and means of overcoming existing obstacles to the full and effective protection of the rights of indigenous peoples, to pay special attention to the human rights and fundamental freedoms of indigenous children and women, and to take into account a gender perspective in the performance of the mandate.

In a resolution (A/HRC/42/L.27) on the protection of the rights of workers exposed to hazardous substances and wastes, adopted without a vote, the Council encourages States, business enterprises and other actors to implement the 15 principles presented by the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes through their respective legal and policy frameworks, as well as through initiatives and programmes to strengthen the coherence between human rights and occupational health and safety standards with regard to the exposure of workers to toxic substances.

In a resolution (A/HRC/42/L.34/Rev.1) on arbitrary detention, adopted without a vote, the Council decides to extend the mandate of the Working Group on Arbitrary Detention for a further period of three years, and requests the Working Group to prepare a study on arbitrary detention related to drug policies to ensure that upholding the prohibition thereon is included as part of an effective criminal justice response to drug-related crimes, and that such a response also encompasses legal guarantees and due process safeguards, and to submit to the Council at its forty-seventh session a report thereon, and to bring the report to the attention of the Commission on Narcotic Drugs as the policymaking body of the United Nations with prime responsibility for drug-control matters.

In a resolution (A/HRC/42/L.36) on the right to development, adopted by a vote of 27 in favour, 13 against and 7 abstentions as orally revised, the Council decides that, at its twenty-first session, the Working Group on the Right to Development will commence the elaboration of a draft legally binding instrument on the right to development on the basis of the draft prepared by the Chair-Rapporteur. The Council further decides to extend for a period of three years the mandate of the Special Rapporteur on the right to development, and to organize a biennial panel discussion on the right to development, starting at its forty-fifth session. It also decides to establish a subsidiary expert mechanism to provide the Council with thematic expertise on the right to development that shall consist of five independent experts who shall serve for a three-year period. The expert mechanism shall report annually to the Human Rights Council on its work and shall meet once annually for three days in Geneva and once annually for three days in New York.

In a resolution (A/HRC/42/L.37) on the question of the death penalty, adopted by a vote of 26 in favour, 14 against and 6 abstentions, the Council decides that the upcoming biennial high-level panel discussion to be held at the forty-sixth session of the Human Rights Council will address the human rights violations related to the use of the death penalty, in particular with respect to whether the use of the death penalty has a deterrent effect on crime rate, and requests the Office of the High Commissioner to prepare a summary report on the panel discussion and to submit it to the Human Rights Council at its forty-eighth session.

Action on Resolutions under Agenda Item 4 on Human Rights Situations that Require the Council’s Attention

In a resolution (A/HRC/42/L.4/Rev.1) on the situation of human rights in the Bolivarian Republic of Venezuela, adopted by a vote of 19 in favour, seven against and 21 abstentions, the Council requests the United Nations High Commissioner for Human Rights to prepare a comprehensive written report on the situation of human rights in Venezuela and to present the report to the Council at its forty-fourth session. The Council decides to establish, for a period of one year, an independent international fact-finding mission and to dispatch that mission urgently to Venezuela to investigate extrajudicial executions, enforced disappearances, arbitrary detentions and torture and other cruel, inhumane or degrading treatment since 2014, with a view to ensuring full accountability for perpetrators and justice for victims. The Council requests the mission to present a report on its findings during an interactive dialogue at its forty-fifth session.

In a resolution (A/HRC/42/L.10/Rev.1) on the situation of human rights in Burundi, adopted by a vote of 23 in favour, 11 against and 13 abstentions, the Council decides to extend the mandate of the Commission of Inquiry on Burundi in order for it to deepen its investigations, including into respect for and observance of political, civil, economic and social rights in the electoral context, until it presents a final report to the Human Rights Council during an interactive dialogue at its forty-fifth session and to the General Assembly at its seventy-fifth session. The Council requests the Commission to present an oral briefing to the Council at its forty-third and forty-fourth sessions during an interactive dialogue.

In a resolution (A/HRC/42/L.22) on the human rights situation in the Syrian Arab Republic, adopted by a vote of 27 in favour, six against and 13 abstentions, the Council deplores the fact that the conflict in the Syrian Arab Republic continues in its ninth year with its devastating impact on the civilian population, and urges all parties to the conflict to abstain immediately from any actions that may contribute to the further deterioration of the human rights, security and humanitarian situations. The Council demands that the Syrian authorities cooperate fully with the Human Rights Council and the Commission of Inquiry by granting the Commission immediate, full and unfettered access throughout the Syrian Arab Republic, and expresses deep concern about the grave humanitarian situation in the country and at the plight of the 11.7 million people in need of full, timely, immediate, unhindered and safe humanitarian assistance.

The Council welcomes the work of the International, Impartial and Independent Mechanism to Assist in the Investigation and Prosecution of Persons Responsible for the Most Serious Crimes under International Law Committed in the Syrian Arab Republic since March 2011 and its close cooperation with the Commission of Inquiry and Syrian civil society, and invites Member States to actively support the Mechanism and to provide adequate financial means for its functioning. The Council further welcomes the steps taken by Member States to prosecute the most serious crimes under international law committed in the Syrian Arab Republic in national courts under the principles of universal jurisdiction and extraterritorial jurisdiction as an important contribution to end impunity and ensure justice for victims.

Action on Resolution under Agenda Item 5 on Human Rights Bodies and Mechanisms

In a resolution (A/HRC/42/L.33/Rev.1) on cooperation with the United Nations, its representatives and mechanisms in the field of human rights, adopted by a vote of 36 in favour and 11 against, with no abstentions, as orally revised, the Council calls upon States to combat impunity by conducting prompt, impartial and independent investigations and pursuing accountability for all acts of intimidation or reprisal by State and non-State actors against any individual or group who seeks to cooperate, cooperates or has cooperated with the United Nations, its representatives and mechanisms in the field of human rights, and by condemning publicly all such acts, underlining that these can never be justified.

Action on Resolution under Agenda Item 9 on Racism, Racial Discrimination, Xenophobia and Related Intolerance

In a resolution (A/HRC/42/L.28/Rev.1) From rhetoric to reality: a global call for concrete action against racism, racial discrimination, xenophobia and related intolerance, adopted without a vote as orally revised, the Council requests the Office of the United Nations High Commissioner for Human Rights to organize, before the eleventh session of the Ad Hoc Committee on the Elaboration of Complementary Standards to the International Convention on the Elimination of All Forms of Racial Discrimination, a two-day expert seminar to consider the elements of a draft additional protocol to the Convention. It further requests the Group of Independent Eminent Experts on the Implementation of the Durban Declaration and Programme of Action to convene its seventh session for five working days during 2020 and to submit a report to the General Assembly at its seventy-fifth session.

Action on Resolutions under Agenda Item 10 on Technical Assistance and Capacity Building

In a resolution (A/HRC/42/L.3) on promoting international cooperation to support national mechanisms for implementation, reporting and follow-up, adopted without a vote, the Council requests the Office of the High Commissioner to organize five regional consultations to exchange experiences and good practices relating to the establishment and development of national mechanisms for implementation, reporting and follow-up, and their impact on effective implementation of human rights obligations and commitments.

In a resolution (A/HRC/42/L.12) on technical assistance and capacity-building for Yemen in the field of human rights, adopted without a vote, the Council requests the United Nations High Commissioner for Human Rights to continue to provide substantive capacity-building and technical assistance to the Government of Yemen and technical support to the National Commission of Inquiry to ensure that it continues to investigate allegations of violations and abuses committed by all parties to the conflict in Yemen, and requests the High Commissioner to present a written report on the implementation of technical assistance at the Council’s forty-fifth session.

In a resolution (A/HRC/42/L.15) on the enhancement of technical cooperation and capacity-building in the field of human rights, adopted without a vote, the Council decides that the theme of the annual thematic panel discussion under agenda item 10, to be held during its forty-fourth session, will be “Upholding the human rights of prisoners, including women prisoners and offenders: enhancing technical cooperation and capacity-building in the implementation of the Nelson Mandela Rules and the Bangkok Rules”.

In a resolution (A/HRC/42/L.26/Rev.1) on assistance to Somalia in the field of human rights, adopted without a vote as orally revised, the Council decides to renew the mandate of the Independent Expert on the situation of human rights in Somalia for a period of one year and requests the Independent Expert to report to the Human Rights Council at its forty-fifth session and to the General Assembly at its seventy-fifth session.

In a resolution (A/HRC/42/L.29/Rev.1) on technical assistance and capacity-building in the field of human rights in the Democratic Republic of the Congo, adopted without a vote, the Council requests the United Nations High Commissioner for Human Rights to present an oral update on the situation of human rights in the Democratic Republic of the Congo at its forty-third session and a comprehensive report at its forty-fifth session.

In a resolution (A/HRC/42/L.30) on technical assistance and capacity-building to further improve human rights in the Sudan, adopted without a vote as orally revised, the Council decides to renew the mandate of the Independent Expert on the situation of human rights in the Sudan for period of one year recognising the intention to phase out the mandate and requests the Independent Expert to present a report on the implementation of his mandate to the Human Rights Council at its forty-fifth session. The Council requests the Government of the Sudan and the Office of the High Commissioner to present their oral reports on progress towards the opening of a country office during an enhanced interactive dialogue at the Council’s forty-forth session.

In a resolution (A/HRC/42/L.31) on technical assistance and capacity-building in the field of human rights in the Central African Republic, adopted without a vote, the Council decides to renew, for one year, the mandate of the Independent Expert on the human rights situation in the Central African Republic and to organize, at its forty-third session, a high-level interactive dialogue to assess the evolution of the human rights situation on the ground, placing special emphasis on preventing the recruitment and use of children in the armed conflict and protecting their rights through their demobilization and reintegration.

In a resolution (A/HRC/42/L.35/Rev.1) on the advisory services and technical assistance for Cambodia, adopted without a vote, the Council decides to extend for two years the mandate of the Special Rapporteur on the situation of human rights in Cambodia, and requests the Special Rapporteur to report on the implementation of her mandate to the Human Rights Council at its forty-fifth and forty-eighth sessions.
