UN Experts urge EU to take the lead on protecting human rights defenders in context of business

The European Union has a chance to set an example for the entire world by protecting people who risk their lives standing up for human rights in the context of business activities, said Mary Lawlor, UN Special Rapporteur on the situation of human rights defenders, joined by the UN Working Group on the issue of human rights and transnational corporations and other business enterprises known as the Working Group on Business and Human Rights), Mr. Surya Deva (Chairperson), Ms. Elzbieta Karska (Vice-Chairperson), Mr. Githu Muigai, Mr. Dante Pesce, and Ms. Anita Ramasastry; and Mr. Fernand de Varennes, Special Rapporteur on minority issues.

The European Union legislative initiative on mandatory human rights and environmental due diligence “must include safeguards for human rights defenders,” they stated on 6 September 2021.

The European Union, as the world’s largest single market, has a golden opportunity to advance the safety and security of human rights defenders who are working around the globe to build more just societies, often at great personal risk,” Lawlor said. “A robust, binding regime in the EU covering companies of all sizes would provide a powerful model for other parts of the world.”

Human rights defenders often risk their lives confronting violations along supply chains, Lawlor said. “Parent companies must carry out human rights and environmental due diligence throughout their supply chains to ensure human rights defenders are not subjected to reprisals from their subsidiaries, sub-contractors and suppliers,” she said. “The EU must ensure that where such retaliation happens, these companies can be held accountable.”

In the 10 years since the Human Rights Council adopted the UN Guiding Principles on Business and Human Rights, business compliance has remained extremely low. In the same period, increasing numbers of human rights defenders have been killed for their work. The UN Working Group on Business and Human Rights has recently developed guidance setting forth expectations that businesses address risks to defenders and that States address this as part of their own mandatory human rights due diligence regulations.

People who stand up for human rights related to environmental protection, community land rights, indigenous peoples’ rights, poverty, minorities and business accountability – often intertwining issues – are most at risk of being attacked or killed.

Where human rights defenders come under attack in the context of business activities it is a clear sign of other underlying human rights issues.” Lawlor said. Potential risks for human rights defenders should be seen as a key component of companies’ due diligence duty to identify and assess human rights risks connected to their projects, and must be specifically included in the expected EU proposal.

Business enterprises must also be obliged to consult with defenders under the EU initiative, and the door should be kept open for defenders to bring issues to companies’ attention at every stage within business projects,” Lawlor said. “

“Now is the time for the EU to give new life to its founding principles by delivering a strong law that could help reduce the number of lives lost in defence of human rights,” Lawlor said.

Business and human rights: Updated list of companies supporting HRDs

Business support for HRDs & civic freedoms does exist but is not widespread. The Business and Human Rights Resource Centre just updated its list of 29 companies that do.

One of the most important and urgent opportunities for responsible business is to support civic freedoms – freedoms of association, assembly, expression and privacy – and the people who exercise the rights to defend all human rights. There is a clear normative responsibility for companies to respect human rights, as set forth in the Guiding Principles on Business & Human Rights (UNGPs), and companies also have a discretionary opportunity to go above and beyond these defined responsibilities and expectations. The UNGPs are a hard floor, not a low ceiling, for company action to support civic freedoms and human rights defenders (HRDs). This page gathers the latest news on business action in support of human rights defenders and features a collection of company and investor policies that mention HRDs.

This would seem to fit nicely with the Open call for input by the UN: June 2021 marks the tenth anniversary of the unanimous endorsement by the Human Rights Council of the United Nations Guiding Principles on Business and Human Rights (UNGPs). A major step forward in efforts to prevent and address business-related human rights abuse, they provide a global authoritative framework for State duties and business responsibilities to achieve the UNGPs’ vision of “tangible results for affected individuals and communities, and thereby also contributing to a socially sustainable globalization.”

UN Working Group on Business and Human Rights is undertaking a new project to chart a course for a decade of action on business and human rights. This effort, informed by wide-ranging stakeholder consultations, will take stock of achievements to date, assess existing gaps and challenges, and, most importantly, develop an ambitious vision and roadmap for implementing the UNGPs more widely and more broadly between now and 2030.

Davos should address human rights violations say UN Working Group on Business and Human Rights.

As global leaders converge in Davos for the World Economic Forum, a group of United Nations experts called attention to the critical importance of human rights to the Forum’s objective this year which is: “Creating a Shared Future in a Fractured World”. “What we are seeing in the world today is the economically disenfranchised yearning for a fairer economic system that spreads the rewards of economic development to all,” said Anita Ramasastry, who chairs the UN Working Group on Business and Human Rights. “The inclusion of human rights objectives into political and economic decisions are crucial if economic reforms are to tackle the root causes of populism, global unrest, climate change and inequality”. The experts stressed how Government and business leaders meeting in Davos wield the power and influence to set the world on a more inclusive and sustainable path. They recalled how world leaders had pledged “to realize the human rights of all” and “to leave no one behind” as core aspirations of United Nation Sustainable Development Goals to be achieved by 2030, and called on business leaders to support this pledge.

Governments and businesses should use the occasion of Davos to announce concrete actions to bring about positive change”, the experts said. “First of all, Governments and businesses must act in accordance with the UN Guiding Principles on Business and Human Rights by taking steps to respect the rights of workers across supply chains and avoid that business operations cause or contribute to adverse human rights impacts”.

The experts welcomed that the 2018 World Economic Forum includes a session on the “Global Prospects for Human Rights”, on the occasion of this year’s 70th anniversary of the Universal Declaration of Human Rights. At the same time, they regretted that human rights were inadequately captured in the World Economic Forum Global Risk Report 2018, released on 17 January 2018.

We call on Governments and business leaders at Davos to remind reach other that human rights are not a fringe issue but at the very core of what needs to be done to address the most pressing global risks,” the experts concluded.

The UN Working Group on human rights and transnational corporations and other business enterprises was established by the UN Human Rights Council in June 2011. Its current members are: Ms. Anita Ramasastry (current Chairperson), Mr. Michael Addo, Mr. Surya Deva, Mr. Dante Pesce (current Vice-Chairperson) and Mr. Pavel Sulyandziga.

Side event on human rights defenders working on Business and Human Rights issues

This side event will take place during the UN Forum on Business and Human Rights. The event will bring together multiple stakeholders to discuss how to remedy, redress and prevent attacks against human rights defenders working on business and human rights.

Human Rights Defenders in National Action Plans on Business and Human Rights: Launch of Guide with public debate on 15 June
