In the early hours of 6 April, human rights lawyer Mr Wang Quanzhang was released from detention in the province of eastern Jiangsu, approximately 56 hours after he was detained and placed under a 10-day judicial detention for “disrupting court order”. The human rights defender was detained for photographing a document which he had been asked to submit to the court, as it was his only copy! The Jingjiang People’s Court released Wang Quanzhang on the grounds that the short detention had already served as a punishment and a warning. However, the human rights defender believes that his release is due to public pressure. Wang Quanzhang had been defending Mr Zhu Yanian, who is a member of Falun Gong and was being tried for ‘using a cult organisation to undermine the implementation of the law’.

On 18 February 2013, a number of human rights defenders and civil society organisations were publicly accused of carrying out a “well orchestrated campaign of disinformation” and of publishing defamatory and false material on a military task force in the Aguán region, “damaging the image of the nation”. The allegations were made during a press conference convened by the Commander of the Joint Task Force “Xatruch III” German Antonio Alfaro Escalante.
During the press conference, the Plataforma Agraria Regional del Aguán (Regional Agricultural Platform of Aguán) and human rights defenders Messrs Wilfredo Paz, Vitalino Alvarez, Yoni Rivas and Marvín Palacios were accused of publishing false accusations regarding Xatruch III through online networks and international human rights organisations. The websites Defensoresenlinea.com, Voselsoberano.com and Hondurastierralibre.com were each accused of publishing material accusing the Task Force of intimidating, threatening and killing people Colón. Friday, 1 February 2013 Diego Martinez, national executive secretary, and Jeison Pava of the Permanent Committee for Human Rights (CPDH), have suffered threats in the last weeks. On 16th January, an anonymous call was made to the CPDH head office in Bogota, asking after Mr. Pava, his timetable and when he would be coming and going from the office. On the receptionist’s refusal to relay this information, the caller insulted her and said “We need that head” referring to Mr. Pava. On 28th January, Mr. Martinez’ bodyguard was detained by units of the National Police. Mr. Martinez informed the police officers that this would leave him without security, however the police officers continued their operation. The police then also asked Mr. Martinez to come with them, despite having committed no crime, but he refused. One of the police officers refused to identify himself, and when Mr. Martinez went to lodge a complaint at the police station, they point-blank refused to receive his report. The same police unit has since returned to the CPDH headquarters, threatening Mr. Martinez against denouncing the crime.
On 4th July 2012, Martinez and Pava were described as military targets. Other members of the CPDH human rights organization have also been threatened in recent months, including Harry Caicedo, director of the CPDH branch in Charco, Narino, whose house was shot at in the night on 13th January, following an arson attack months before. CPDH has been requesting security measures since August 2010 and in May 2012 was granted “precautionary measures” by the Inter-American Commission of Human Rights. In December 2012 the government finally provided the requested security. CPDH has expressed concern that, only one month on, in Mr. Martinez’ case, state forces removed the protection they are obligated to provide.

Two NGOs, Stockholm-based Civil Rights Defenders and Dublin-based Front Line Defenders, have expressed concern for the safety of two human rights defenders in the Transnistria, the internationally unrecognised separatist republic of Moldova. Stepan Popovsky andVladimir Maimust are the subject of judicial harassment and threats by the local administration.
On 9 January 2013, Stepan Popovsky, a private lawyer and chairperson of the Republican Social Movement for the Protection of Property and Social Rights of Peasants, held a meeting where he provided legal support to local peasants. The meeting was interrupted by police officers accusing him of trespassing on a private area, although the Criminal Code of Transnistria does not define trespassing as a criminal offense. One week after the incident, Stepan Popovsky was informed that a criminal case had been initiated against him. He responded with a letter of complaint to the local Minister of Internal Affairs. Since then, Stepan Popovsky has been repeatedly threatened by Transnistrian region’s law enforcement officers while performing his profession as a lawyer. A few months earlier, Stepan Popovsky was the subject of a defamatory media campaign that presented him as a foreign spy earning millions of dollars by buying local real estate.
The human rights lawyer Vladimir Maimust is also under pressure from the Transnistrian authorities. He is the lawyer of a person who was detained by the Transnistrian authorities on 23 June 2012 and who later died from suffocation in jail on 21 November 2012. Vladimir Maimust filed a complaint to the local Investigation Committee and to the Transnistrian leader Yevgeny Shevchuk, in which he accused the investigator of abuse of power and negligence that led to the death of his client. Vladimir Maimust was later threatened by KGB agents “to be included in the list of persons whose activity on the territory of the republic has to be undermined” and that criminal charges can be brought against him. During a working visit to the Investigation Committee on 11 January 2013, the human rights lawyer was beaten and injured by four men in police uniform who also tried to slip an unknown package into his pocket, accusing him of being drunk although medical expertise later confirmed that there was no sign of alcohol consumption. A criminal case has been recently opened against Vladimir Maimust for conspiracy. If found guilty, he may face up to 12 years in prison.
Civil Rights Defenders and Front Line Defenders believe that the threats and the fabricated criminal cases against Stepan Popovsky and Vladimir Maimust are directly related to their human rights work. The organisations urge the representatives of the Transnistrian administration to launch an immediate and impartial investigation into the threats against the human rights defenders, to protect them from any further threats or attacks, and to ensure that all human rights defenders in the region can carry out their legitimate human rights activities without fear of reprisals and free of all restrictions, including judicial harassment.

On 28 January 2013, a number of Brazilian civil society organisations and social movements addressed an open letter to the Coordinator of the National Programme for the Protection of Human Rights Defenders (NPPHRD) and the Presidency regarding the security situation for human rights defender Alexandre Anderson de Souza.
Alexandre Anderson de Souza is head of the Associação dos Homens do Mar – AHOMAR (Association of Seamen), an organisation set up to defend the rights of the fisherfolk working in Rio de Janeiro, and particularly those affected by the construction of a gas pipeline for Petrobras. AHOMAR argues that there are reports of environmental permit irregularities in the construction of the pipeline and it will have a negative impact on local flora and fauna as well as on the livelihood of those who fish in those waters in the Guanabara Bay.
Alexandre Anderson de Souza has suffered a number of threats to his life and has been under the NPPHRD since 2009, but the federal government has delegated the responsibility to authorities in the state of Rio de Janeiro, where he and his family live. However, the human rights defender and a number of Brazilian civil society organisations and social movements that support him, have been repeatedly expressing their discontent with the protection offered by the state programme and the conditions in which Alexandre Anderson de Souza, his wife Ms Daize Menezes and their children have been forced to live. As the situation has worsened the human rights defender and his family have had to relocate to different hotels in the city of Rio de Janeiro but the locations were highly insecure. The buildings did not have 24-hour reception personnel and the rooms they were accommodated in had no telephone. The protection programme has been unable to ensure Alexandre and his family’s return to their residence in Magé, and as a result the human rights defender remains unable to resume his work at AHOMAR. Four members of AHOMAR have been killed to date.
Another point of discontent with the state protection programme has been the unsatisfactory level of legal support provided to the human rights defender by the non-governmental organisation (NGO) Projeto Legal (Legal Project). Projeto Legal has signed an agreement with the government of the state of Rio de Janeiro, in the context of the state protection programme, to provide legal support and advice to the human rights defenders included in the programme. After repeated complaints about the NGO’s inaction in several instances, Alexandre Anderson de Souza received information from a reliable source that one of Projeto Legal’s main funders is Petrobras, the same oil company whose actions the human rights defender and his organisation AHOMAR have been trying to hold accountable for environmental damages. The information was confirmed on the websites of both Petrobras and the NGO, but neither they, nor the government of the state of Rio de Janeiro, have clarified the terms of the agreement, raising doubts over the impartiality of the organisation and a conflict of interests.
The open letter signed by several civil society organisation addressed the main concerns of Alexandre Anderson de Souza and other NGOs working with human rights defenders in the country. While welcoming the formal establishment of the state of Rio de Janeiro’s protection programme for human rights defenders through the Decree 44.038 signed on 18 January 2013, the letter asks for Alexandre and his wife Daize, as well as other human rights defenders who are currently under the protection of the state, to have their security ensured by the National Protection Programme until the state protection programme is fully operating and able to fully ensure the safety of human rights defenders in the territory of the state of Rio de Janeiro.
Front Line Defenders is gravely concerned following reports of the vulnerable security situation of human rights defender Alexandre Anderson de Souza and his family, and of other human rights defenders under the protection of the state of Rio de Janeiro.

As of today one can also nominate for the Lawyers for Lawyers Award a lawyer, or a group of lawyers, who work to promote the rule of law and human rights in an exceptional way and who have been threatened, obstructed or in any other way hindered because of their work as a lawyer. An additional criterion is that this lawyer, or group of lawyers, may benefit from the publicity and recognition of the Lawyers for Lawyers Award.
The Lawyers for Lawyers Award, organised by the Netherlands-based NGO with the same name, will be presented for the second time in Amsterdam on 23 May 2013. An independent jury, consisting of Heikelien Verrijn Stuart, Theo van Boven, Egbert M
yjer and Els Swaab, will decide which lawyer will receive the award. The prize consists of a donation of €10.000. Anyone can submit a nomination, but a lawyer or group of lawyers cannot nominate themselves. The closing date for submission of nominations is 15 February 2013.

One month after being physically assaulted, human rights defender and journalist António Capalandanda continues to be subjected to threats and acts of surveillance and intimidation. António Capalandanda is a journalist at on-line news and radio site Voz da América (Voice of America) in Angola. His work has focused on human rights and political violence in the country, as well as investigation of corruption cases involving public officials.
On various occasions in early January 2013, António Capalandanda was reportedly followed by unidentified men in a vehicle, who parked close to his residence and followed him as soon as he left for work. During the same period the email of António Capalandanda was hacked by unknown individuals according to his email service provider, which registers the time and Internet Protocol (IP) address when his account is accessed.
On 7 December, 2012, two unidentified men on a motorbike assaulted the journalist and stole his camera, a voice recorder and two notepads. One of the men also attempted to take his backpack, unsuccessfully. On the same day, António Capalandanda filed a complaint at Huambo Provincial Police Directorate for Criminal Investigation. The officer who registered the case stated that this type of assault was unusual in the region and added that it seemed the human rights defender was being subjected to surveillance.
António Capalandanda has previously received a number of death threats from individuals identified as state security agents and has been offered to work for the Government in return for the ceasing of his journalism work. The human rights defender’s family members and friends have also been reportedly subjected to acts of harassment.
On 5 December 2012, two days prior to the abovementioned assault, António Capalandanda was approached by a man who identified himself as an agent of the state security services, and issued death threats against the journalist.
Front Line Defenders expresses serious concern at the continued acts of threats, surveillance and intimidation directed at António Capalandanda, as well as his family members and persons close to him, and believes that these acts are motivated by the legitimate and peaceful activities of António Capalandanda as an investigative journalist and human rights defender in Angola.

The ‘new’ Commissioner for Human Rights of the Council of Europe (who took office on on 24 January 2012) Nils Muižnieks stated in his end of the year message some hard truths about the position of human rights defenders in Europe.
”Defamation, threats, verbal and physical attacks, sanctions and judicial harassment are used to deter human rights activists from working with migrants.” Nils Muižnieks states that in several Council of Europe countries, the rise of xenophobic and anti-migrant discourse has “negatively impacted” on the work of human rights defenders who protect and promote the rights of migrants.“Human rights defenders are even increasingly labelled as traitors who are threatening national identity and security,” he adds. “They are often exposed to intimidation and abuse.
“The situation in Greece is particularly worrisome as migrants have become targets of unacceptable, extreme violence notably by members, including MPs, of the far right political party of Golden Dawn.“Human rights defenders defending migrants are under threat. There have been several instances of lawyers being threatened and physically attacked in Athens as they were assisting migrants in the course of asylum and other legal procedures.
“In some Council of Europe countries the work of defenders working with migrants and their rights is being criminalised. In France, legal provisions corresponding to the so-called délit de solidarité the offence of solidarity concretely result in law enforcement bodies pressuring and punishing human rights defenders providing assistance to irregular migrants. Persons standing up for the rights of migrants have been detained, prosecuted and/or fined.“ “In Belgium, similar tendencies have been identified and persons who have been demonstrating in favour of the rights of migrants have been arrested.”

Asma Jahangir MEA Laureate
The Friday Times of June 8, 2012 carries an interesting article in which Raza Rumi talks to Ali Dayan Hasan, the Pakistan Director at Human Rights Watch. The response to the question: “But critics would argue that Asma Jahangir is a politicised figure and she has offered no proof to substantiate her allegations…” is so good and clear it is worth quoting in full: “Let me be blunt. Asma Jahangir is no ordinary person. She is an activist of 30 years with a demonstrable record of unflinching integrity. Not only is she a figure viewed with admiration in Pakistan, she is seen as an icon by many in the international human rights movement. During these decades, she has been a consistent critic of the military and intelligence agencies but has never made such an allegation. But when she speaks the world hears respectfully and with attention. It is for the government of Pakistan to fully investigate the matter and unearth the truth of the matter. And I want to be absolutely clear: the intelligence apparatus must understand that if any harm comes to Asma Jahangir, the response from the international community will be severe.”. Asma was the second person to win the Martin Ennals Award for Human Rights Defenders in 1995!.
