Sports and human rights: focus on ‘sports washing’ – big names play for big money

Sports and human rights (or as some like to say ‘sports and politics‘) remains a hotly disputed topic. While the organized sport world (FIFA, IOC) is slowly coming around to take these matters more seriously [see e.g. https://humanrightsdefenders.blog/2018/12/03/fifas-second-report-on-human-rights-misses-sustainable-approach/  and  https://humanrightsdefenders.blog/2018/12/03/olympic-committee-tries-its-hands-on-human-rights-cautiously/], it seems that less progress is made with sports events organized by repressive regimes simply to boost their image. Recently called ‘sports washing‘ [The term was coined in relation to a planned tennis exhibition match in Jeddah last December between Novak Djokovic and Rafael Nadal, – https://humanrightsdefenders.blog/2018/10/19/novak-djokovic-and-rafael-nadal-have-a-chance-to-score-a-point-for-human-rights-defenders/. It never went ahead due to an injury of Nadal.]. Azerbaijan in 2015 tried to make good use of sporting events (see e.g.    https://humanrightsdefenders.blog/2015/06/12/baku-games-starting-today-with-avalanche-of-human-rights-criticism/; and https://humanrightsdefenders.blog/2015/04/21/azerbaijan-a-formula-for-combining-sports-and-repression/).

Now the regime of Saudi Arabia hopes that it can buy its way to a better image with hosting sport events and Amnesty International has warned sports stars not to become a propaganda tool. Saudi Arabia said it has hired the former England captain, David Beckham, to lead an exhibition team against his former Real Madrid teammate Zinedine Zidane.  The game, to be held later this year, is part of a £60-billion re-launch of the entertainment industry in Saudi Arabia, called the National Transformation Programme. According to an article in the Sun, it would earn Beckham an estimated £1million. [Beckham also has a lifetime endorsement deal worth £120million with Adidas which I think doesn’t sit well with Adidas’ claimed stance in favor of human rights – see e.g. https://humanrightsdefenders.blog/2018/12/13/first-time-major-companies-say-that-human-rights-defenders-are-essential-for-profitable-business/].

Announcing the match in front of big screen images of the football legends, Saudi sports minister Turki Al-Sheikh said: “This is an exhibition match including two big worldwide stars – Zinedine Zidane and David Beckham playing against each other…If God wills, you will see it this year in the Kingdom of Saudi Arabia.

The UN children’s aid group UNICEF, for whom Beckham is a goodwill ambassador, has criticised the Saudi-led coalition saying its bombing attacks there have had catastrophic consequences for the local population. Saudi Arabia has detained more than a dozen women’s rights activists such as Loujain al-Hathloul who once appeared in a Vanity Fair.  Loujain’s sister, Alia, has criticised US singer Mariah Carey for playing a concert on Thursday at the King Abdullah Economic City. She said: “My own baby sister said she is being whipped, beaten, electrocuted and harassed on a frequent basis.” She stated: “Remember, thanks to my sister @LoujainHathloul, you r able to perform in Saudi Arabia. I wish she can attend your concert. But she’s locked behind bars because she tried to improve women’s condition. My post yesterday was about golfershttps://humanrightsdefenders.blog/2019/01/31/amnesty-international-calls-on-golfers-not-to-play-the-saudi-propaganda-game/] who were being paid $ 1million when the European Tour staged a tournament in Saudi Arabia. While Paul Casey decided not to take part on human rights grounds, Justin Rose and Ian Poulter did play.

How difficult if not impossible it is to try and separate sports and politics can be illustrated by the recent case of soccer player, Hakeem al-Araibi, a Bahrain-born soccer player for a team in Australia has been held in detention in Thailand [see https://humanrightsdefenders.blog/2019/01/02/craig-foster-australian-footballer-and-human-rights-defender/].  Hannah Beech in the NYT on 31 January 2019 puts the question “Can Big Global Sports Come Around to Human Rights Advocacy?

The global sports market is worth hundreds of billions of dollars a year. Now, this powerful industry is coming together to promote an unlikely cause: human rights. Since late November, a Bahrain-born soccer player for a minor team in Australia has been held in detention in Thailand. The player, Hakeem al-Araibi, 24, is not a famous athlete. He has no lucrative sponsors. But he has spoken out against one of the most powerful men in international soccer, who is also a member of the ruling family of Bahrain. His testimony of torture at the hands of Bahrain’s repressive government earned him refugee status in Australia, which determined that he faced credible threats of persecution should he return to the Gulf state. Still, over the past week, Mr. Araibi has collected an impressive list of supporters in the world of international sports.

  • Fatma Samoura, the secretary general of FIFA, has called for Thailand to return him to Australia “as a matter of urgency.”
  • Thomas Bach, the head of the International Olympic Committee, raised the issue with the United Nations High Commissioner for Refugees.
  • Praful Patel, of the Asian Football Confederation, issued a statement asking the Prime Minister of Thailand to ensure Mr. Araibi’s return to his adopted home.

[By the way, the head of the Asian Football Confederation is Sheikh Salman bin Ebrahim al-Khalifa, the Bahraini official whom Mr. Araibi accused of not stopping the persecution of athletes in his charge. Sheikh Salman also serves as a FIFA vice president.!]

Mary Harvey, the chief executive of the Center for Sports and Human Rights, said:  “Hakeem is a historic test case, because it’s the first time that we’ve seen these big, powerful sports bodies all come together publicly to address the fate of a single person”. [see also: https://humanrightsdefenders.blog/2018/12/12/mary-harvey-her-goal-is-now-human-rights/]. The court ordered al-Araibi, who is in the Bangkok Remand Prison, to appear before it at 8.30am on Monday to answer whether or not he is willing to be extradited,  lawyer Bergman said.

First time major companies say that human rights defenders are essential for profitable business

The statement is the first of its kind, with supporters including Unilever, Adidas, Primark, ABN AMRO, Anglo American, Leber Jeweler, Domini and the Investors Alliance on Human Rights. It stresses that when human rights defenders are under attack, so is sustainable and profitable business….Human rights defenders, civil society organizations, international organizations and progressive governments have been insisting for years that if civic freedoms which allow citizens to propose solutions to social problems, and to push governments to respect and protect human rights, are eroded, so are any prospects for sustainable development and just and inclusive economic growth. Now, these voices have been joined by a group of well-known brands and investors who are vocal about how they, too, depend on the rule of law, accountable governance, stable investment environments and respect for human rights. Read the statement here.

2017 (9): Business can be better allies of human rights defenders

 Just discovered that the penultimate post in my series “2017” was never published. So here comes – with delay- the missing piece “2017 (9)“:

With the USA government abandoning any leadership on human rights issues, perhaps we should turn more to the business world. So writes Sarah Brooks who works for the Geneva-based NGO, the International Service for Human Rights, in Open Democracy on 1 February 2017 (“Business can and should ally with those defending human rights”)

Business should heed the views of human rights defenders, and do more to protect their crucial work—which advances the rule of law that benefits business too. Global businesses and grassroots human rights activists may seem like strange bedfellows.  But as attacks on basic democratic freedoms and the rule of law intensify around the world, they may have more shared values and interests than one might think. We know businesses are driven by the bottom line. If they didn’t seek to increase profits, they simply wouldn’t exist. But we also know—and many business leaders are coming around to the idea—that long-term success relies on more than just profit generation and is linked to a range of external factors such as transparency, certainty, stability. And a social license to operate. Failures to understand that social license, and in particular to prevent and respond to the human rights impacts of their work, have thrust many global businesses into an unwanted spotlight. They didn’t need to find themselves there.

Because human rights defenders use public advocacy as a key tool for change, businesses often make the mistake of seeing them as additional drivers of cost. Reputational damage and operational risks for a company are expensive. Because human rights defenders—such as lawyers, trade unionists, community leaders, or NGO workers—use public advocacy as a key tool for change, businesses often make the mistake of seeing them as additional drivers of cost. However, business should see human rights defenders as priceless allies. They are the canaries in the coal mines, pointing to when governance failures become real financial, legal, and reputational risks to business. They are also the witnesses to corporate abuse of communities and the environment. Because of this, the work of defenders often makes those in power uncomfortable—both states and non-state actors. They are targeted with laws and policies to stifle their activities, and face intimidation and threats to their work and their lives. Yet without the work of defenders, whole societies and economies lose out. And that means businesses lose out, too.

These cases show business can make a difference. It has a unique ability to create, maintain, and defend space for civil society through three tools: leverage, leadership, and partnerships. How do these work? Take as an example a government drafting a law that aims to close down space for NGOs to operate. In addition to running counter to international law, this would also close off channels for businesses to benefit from NGOs’ work—whether implementing community projects or helping train workers. So how might businesses respond? They can use the leverage provided by access, personal relationships and market share to push back on authoritarian impulses. To take just one example, when 30 global brands and global trade unions joined together to speak out against violent dispersal of protests and detention of activists in Cambodia in 2014, not only were the activists released, but the underlying issues of minimum wage took center stage in brand discussions with the government.

Businesses, and especially progressive businesses, also need to show leadership. In 2015, Adidas released a policy statement on human rights defenders that clearly led the pack, creating a company-wide commitment to speak out in defense of fundamental freedoms in the countries where they source. It takes a lot for a business to get in front, especially when they know that NGOs will be watching carefully to see those policies implemented. But setting the bar high has consumer appeal and can drive a race to the top. [see also my: https://humanrightsdefenders.blog/tag/business-and-human-rights/]

Finally, businesses have resources. Partnerships directly with NGOs can be contentious, and businesses need to listen to and address the concerns of co-optation and whitewashing. But the global environment for traditional funding mechanisms is increasingly toxic. According to UN experts and leading funders, nearly a hundred governments have put limits on NGOs’ operations, including the ability to accept foreign (especially NGO) funding. For the financial survival of civil society, seeking support from businesses might be an option—if it is on equal footing and with clear redlines to maintain independence.

Civil society needs space and protection to carry out its work, and it is not just a moral imperative, but an investment opportunity for businesses to help secure that space and protection. The leadership, leverage and solidarity shown by companies who see support to civic freedoms and human right defenders as part of core business will pay long-term dividends.

Along similar lines runs the article “Davos | Global crackdown on civil society and civic freedoms warrants global business response” by the International Service of Human Rights on 20 January 2017:

Business and civil society alike thrive in open democracies. It is in their collective interest that business enterprises play an active role in responding to the global crackdown on human rights defenders and civic freedoms, participants at the World Economic Forum in Davos have been told.

Human rights defenders and other civil society actors play a vital role in promoting and contributing to good governance, sustainable development and the rule of law. This is explicitly recognised in Sustainable Development Goal 16 and its associated indicators. In many cases, this work involves defenders exposing corruption, protesting environmental degradation, and demanding that the benefits of development are shared by all, including the most poor and disadvantaged. In an increasing number of jurisdictions, this work also involves defenders being subject to restrictions and attacks, with recent research demonstrating that those working on land and environment rights and in the field of business and human rights are most at risk of being killed. This week’s assassination of Mexican indigenous and environmental rights activist Isidro Baldenegro is just the most recent tragic example of the global crackdown on human rights defenders and civic freedoms.

What is the role and responsibility, and what should be the response, of business enterprises to this crackdown? This was a key question at the World Economic Forum attended by ISHR representatives in Davos, Switzerland this week. Progressive business enterprises are increasingly recognising the shared values and interest of business and civil society in an open, enabling operating environment. This is an environment characterised by respect for the rights to freedom of expression, association, assembly, access to information, public participation, non-discrimination and the rule of law. It is in such open environments that innovation, productivity and development thrive. Progressive business enterprises are also recognising the significant costs associated with the global crackdown on human rights defenders and civic freedoms, with the World Economic Forum’s most recent Global Risks Reportidentifying the ‘fraying of the rule of law and declining civic freedoms’ as a key business risk. In his statement to the Forum, the UN High Commissioner for Human Rights similarly said: ‘Business cannot thrive in failing societies, where tension spikes and communities bristle with grievances and mutual contempt. Strong civil societies, due process, equality and justice: these are what enable real economic empowerment’.

Business enterprises and business leaders exercise significant influence in shaping public and political opinion and legislative and policy-making processes, not just in areas of corporate and economic policy but on social issues such as LGBTI rights. They should exercise similar influence in response to the increasing restrictions and risks faced by defenders. The conversations in Davos this week recognised the shared interest of business and civil society in the protection of human rights defenders and civic freedoms. The killing in Mexico of Isidro Baldenegro at the same time as these discussions were taking place tragically demonstrates the need for business to move beyond recognition to action.

Adidas and Human Rights Defenders: no longer run-of-the-mill?

In 2012 – in the run up to the London Olympics – the Playfair 2012 Campaign (supported by War on Want and others) highlighted the appalling experiences of workers making Adidas official Olympic and Team GB goods in China, Sri Lanka and the Philippines. “Around the world 775,000 workers, mainly women, in 1,200 factories across 65 countries make Adidas products. Almost all of the jobs are outsourced to factories in poorer countries, yet through Adidas’ buying practices the company has enormous influence over their working conditions, and ultimately their lives. In the run up the London 2012 Olympics research has exposed the harsh reality of life for these workers.” The campaign demanded Adidas to end worker exploitation. playfair2012.org

In a report of 11 March 2015 on Labor Rights Abuses in Cambodia’s Garment Industry Human Rights Watch noted that brands can do more and said “For example, Adidas wrote to Human Rights Watch that it first started privately disclosing its supplier list to academics and nongovernmental organizations (NGOs) in 2001 and moved to a public disclosure system in 2007.”

In an article in Open Democracy of 17 June 2015  Mauricio Lazala and Joe Bardwell under the title: “What human rights?” Why some companies speak out while others don’t.state that:More recently, civil society has called on FIFA sponsors to respond to human rights concerns at construction sites for the Qatar 2022 World Cup. So far, Adidas, Coca-Cola and Visa have issued statements supporting workers’ rights in the country

In an article published on 16 November 2015, ISHR Director Phil Lynch explored the role, responsibility and interest of business when it comes to supporting human rights defenders and protecting civil society space. He mentions Adidas in the following context: The fourth and final category of actions, perhaps the most important but also the least common, involves business actively advocating and seeking remedy for human rights defenders and against laws and policies which restrict them. Such action could be private, as I understand to be the predominant approach of Adidas. It could also be public, such as the open letters and press statements issued by Tiffany & Co and others for the release of Angolan defender and journalist Rafael Marques

On 31 December 2015, the Business and Human Rights Resource Centre listed in its “KnowTheChain” (a ranking of 20 apparel and footwear companies on efforts to address forced labour in the supply chain) Germany-based Adidas as number one out of 20.

On 21 June 2016 Adidas published its policy on HRDs: “The Adidas Group and Human Rights Defenders“. As there is such a dearth of corporate policies specifically on human rights defenders, here follows the key part in quote:

The threats faced by human rights defenders come in many forms – physical, psychological, economic, and social – and involve the interaction of many factors (poor governance, the absence of the rule of law, intolerance, tensions over development issues, etc.) and can be triggered by different actors, both private and State.

In his report to the General Assembly in 2015, the UN Special Rapporteur on the situation of human rights defenders recommended that both States and businesses should play an active role in supporting and promoting the role of HRDs working in their sectors. This should include, for example, speaking out when human right defenders are targeted for their corporate accountability work. Businesses must also cease and abstain from supporting any actions, directly or indirectly, which impinge upon defenders’ rights to freedom of expression, association and assembly.

The adidas Group has a longstanding policy of non-interference with the activities of human rights defenders, including those who actively campaign on issues that may be linked to our business operations. We expect our business partners to follow the same policy; they should not inhibit the lawful actions of a human rights defender or restrict their freedom of expression, freedom of association, or right to peaceful assembly.

We value the input and views of all stakeholders and we are willing, and open, to engage on any issue, be this related to our own operations or our supply chain. Often, our engagement with human rights defenders is constructive, especially where we identify areas of shared concern. For example, with respect to transparency and fair play in sports, or environmental sustainability, or the protection of worker rights in our global supply chain. In these instances, we may actively support the work of the HRD and derive shared value from our joint endeavours in, say, improving working conditions, safety, or the environment.
